    They are trying it on. They must give you 28 days notice before taking you to court.

    Have you sent the letter I gave you yesterday OR a CCA request (the £1 letter)?

    Once you send either letter, it is clear the debt is in dispute and they are required by OFT guidelines to hold off from further action until they investigate the debt. They must also send you the consumer credit agreement and statements etc within 12 days - if they fail they are in default themselves, and if it takes them another 30 days after that they have commited an offence.
