i need advice

Hi,

I have been separated for 2 years now and i have 3 children. When i left my husband i also left the family home as he refused to. He stayed in the family home and i rented with my 3 kids. I have not made any contributions towards the mortgage since October 2010, as i had to pay rent (which was actually more than the mortgage!!). My ex has now stopped paying the mortgage and is declaring himself bankrupt. How will this affect me? the mortgage company has rang me to say the last mortgage payment has not been paid, but i cannot afford to pay it as i am still renting. My ex still refuses to allow me and the children move into the family home, which lies empty all week as he stays at his girlfriends!! yes, he is a real nice guy!... i live in Northern Ireland.

    bigplug, you say your ex isn't allowing you to live there, how is he stopping you? if you are on the mortgage/deeds you have a legal right to reside and the police could accompany you to access the property if need be. However it is only worth it if you can continue to afford the mortgage long term.

    His BR will affect you as any joint debts, which will include any shortfall in the mortgage once the house is (presumably) repossessed and sold, will then leave you solely liable as the lenders can no longer pursue him for the debts. They are likely to chase you for the debt for as long as necessary to try and reduce or remove the debt you owe them.

  • Hi and welcome to the board, the first question before any advice is; is the mortgage on the property joint or solely in his name?
    His BR will affect any joint financial products, so if you have any current or old joint accounts get them closed now, the OR will do this proably anyway on his BR.
    From experience if any child support is by "private arrangement" rather than by the CSA you may want to consider getting the CSA involved to protect payments to you.
