Please Help loan
I dont know what to do, i recently had gastric balloon proceedure, paid £2500 card (1000debit, 1500creditcard), £2500 loan on a fixed 0% agreement.
had the balloon done (12 month support plus unlimited fills, dietician etc)
and had a phone call saying hospital A MONTH after having balloon has gone into admin, they cant offer a fill of what i had been requesting for 2 weeks after having it done as they didnt do their usual 450cc fill they gave me 300cc so not feeling the full effects!
so im now 5k out of pocket with a balloon not helping me at all im at my wits end and so depressed, i rang another private hospital who offer balloon ive had and theyve told me its £600 a fill or £1200 removal which is money i have no way got now i paid for the balloon.
anyone know where i stand or offer advice? so low right now, was happy thinking i had something helping me in life to get fit and healthy but am back at square one, skint and something in me that isnt working =(

There might be a section 75 claim here.
You could pursue it via the interest free loan company or credit card company. I'd start with the loan company.
http://www.moneysavingexpert.com/shopping/section75-protect-your-purchases75. — (1) If the debtor under a debtor-creditor-supplier agreement falling within section 12(b) or (c) has, in relation to a transaction financed by the agreement, any claim against the supplier in respect of a misrepresentation or breach of contract, he shall have a like claim against the creditor, who, with the supplier, shall accordingly be jointly and severally liable to the debtor.0 -
Which hospital is it? It's quite rare to have a one-off independent hospital these days so they might be part of a group and you may be able to chase them down that way. It's even more odd if they phoned you to say that they had gone into administration.....what exactly did they say?
And did they say why they didn't do the usual fill? If there was a medical reason then you may not have a claim against them.....Practically Perfect in Every Way......:grinheart0 -
Hi,
they didnt do usual fill as the consultant advised as i lived far away from the clinic a smaller fill would be better so i can get my body to adjust to the foreign object first then come in for a refill as soon as im use to it, which i was after 7 days..
after over a month of fighting, admins said i cant get any money back as company have non, NHS of england wont help me, NHS of wales are helping welsh patients though, barclaycard are of no help as its apparently cosmetic and the loan company have still taken payment and are saying i still owe money even though i havent got what i paid for at all! i just dont know what to do =(:(0 -
Btw. it was nucleus healthcare/celtic springs in newport wales, im english so welsh nhs wont cover me even though surely my tax/ni pay for them too? =(0
