Debt Collectors/Bailiffs Question

Hi Everyone

I am struggling with debt at the moment and I am in the middle of sorting out all my debts but I have a question.

I am 22 and live at home with my parents. I pay rent to my parents who fully own the house.

I am in about £15,000 worth of unsecured debt with a lot of different creditors.

Are bailiffs/Debt collectors allowed to enter my parents house where I live and take things?

I am really worried and would appreciate any help anyone can give.

    Debt collectors never have any rights to enter anyone's house or take anyone's things.

    Bailiffs can only be instructed if your creditors have been to court and obtained a CCJ against you. Do you have any CCJs?

    If you did then bailiffs could be instructed and come to your parents house. They are not allowed to barge in / break in but if allowed in to the property could do a levy on certain items if they belonged to you.

    Have you been in touch with one of the debt advice charities about the best way to deal with your debts and creditors? If not I would suggest that may be a good option - IMPORTANT - Where to seek professional impartial advice about your debts.

    I will look into the charities.

    I have 2 CCJs so far which I got about a year or 2 ago. I paid a little money on both when I first got them but I only made one small payment on each.

    So you say bailiffs can do a levy on certain items, what if nothing is the house is mine. My parents have paid for all the items in the house. Surely they cannot take my parents things?..

    Yes I have a car fully paid for in my name. It is worth £8000. This has been another concern of mine. Can they take that?

    I do not owe a single creditor £8000 or more. The debt is split up of lots of different accounts. Like about 8 different ones for £800-£1200 and then 6-10 between £400-£600??

    Even if you have CCJs, creditors would have to apply to the court to get a Warrant of Execution before they can send bailiffs. Also when you got your CCJs you'd have agreed to repay a certain amount. If that is no longer affordable, you can apply to the court for a variation order to pay less, by filling in a form with an I&E statement. Some pay as little as £1/month on their CCJs if they are on benefits/low income. Doing things the right way can prevent further enforcement action.
