The company are not going to employ anyone else if the work keeps getting done with the number of staff available. He needs to retract his agreement to working over 48 hours a week. Apparently you can give a weeks notice. He then needs to do his contracted hours and provide a note from the doctor confirming the extra hours are causing issues with his health.

It is is likely that jobs won't get done and things will slip, this is the only way the company will employ anyone to take up the slack.

Make sure his ill health and additional hours are well documented and communicated to the company, so if they try and get rid of him, he has excellent evidence that it was caused by their actions.

    Thanks Judith

I have re read his contract and it says 37.5 hours a wk mon to fri then goes on to say he has to be available a other times inc sat and sun even though the co doesn't work a sun? Dh is really acting strangely and refuses to stand up for himself even though he stands up to me!

He sees it that depression is not a mans illness even though he admits he is depressed. He is not making sense and forgets everything. Any ideas? X

Do you know the situation at the other depots? Whilst HR may be aware the individual works these hours they may deem it to be his choice. There is a difference between someone thinking they have so much work they have to work those hours, and being specifically asked to cover the shifts.

Plenty of people work hours way in excess of 48 per week as they feel it is what is needed to do their job to the standard they believe is required. Often though when it is broken down there are ways to reduce workload, take time out of a process, allocate work elsewhere and delegate, manage expectations that work will take longer etc. I wonder if the other depot managers get the work done in less time and if it might be worth him sitting down with one of them to understand how they manage their diary, what tasks they get involved in and what they delegate etc?

That's good advice jim. I will speak to him about it. I know that other depots work long hours too, it's just that his depot have three staff off sick and are already down on un replaced staff from last year so dh has just been struggling on. Thank you
