Help - Can't get a mortgage

Hi,

I have just spoken to Lifetime Planning who I was recommended to speak to by Miller homes who I am looking to buy a property with. I am looking to use their Miway shared equity scheme to help get me on the ladder.

Unfortunately, they have advised me that they wouldnt be able to offer myself or my partner a mortgage due to my partner having a default on his report. This has just went on for a silly mobile contract he didnt pay for. I also have some credit card debt and a fair credit rating due a few missed payments.

I have found the dream property I want and now I am lost. Originally I quoted a 5% deposit of the property value of £110,995. However, we should be able to put more down of about £10,000 once it comes to buying as the property wont be available until August/September.

Anyone have any advice of what we can do? We have already tried to get the default removed but they wont budge. I am working on getting my credit rating up and paying off my debt.

    How much was the mobile phone default and when was it? Has it been settled? If so, when?

    To be honest, I think calling it a 'silly mobile contract' is a bit of a bad attitude.
  • It was a silly mobile phone contract because the network was rubbish and disputed. My partner was in Afghanistan when the began chasing him for the payment which I had no control over as it was being sent to his grans house who is delusional and basically told them to f- off.

    I do apologize if you think that me referring to it as a silly mobile phone contract is a bad attitude however I think I have a right to refer to it as whatever I want. I am quite upset now at this stupid thing which is not mine, I cant do anything about, or fix. I work my !!! off 7 days a week working 2 jobs, my partner has just spent 7 months in Afghanistan, being blown up and shot at. After all of this, we still can't get no where because of 3 Network (which have been on Watchdog for this problem before).

    I do not know how much the contract originally was for however it is now sitting at around £160. Which he is due to clear but because he lives in Germany it is quite hard for him to phone and sort issues out without a massive bill or being able to use a phone.

    I appreciate that you're upset and believe me, I know exactly how you feel.

    What I would suggest is your partner writing to Three offering to clear the debt in full on the understanding that the default is removed completely from his credit file. Tell them that if they don't agree, it would be more beneficial for your partner to use the money towards another debt. I had some success doing this with another phone provider so if you'd like a copy of the letters I sent which resulted in success, please pm me.

    They wont remove the debt from the credit file - its a legal requirement for them to give an accurate record of your payment history. The best you will get is Satisfied (presuming its paid off)....unless you successfully dispute the debt is not legitimate.

    Just to clarify then, the CCJ is in your partners name only and the lender is saying you alone can not have a mortgage or is it a joint mortgage theyre saying you cant have?

    No-one's mentioned a CCJ, it's a default and it is possible to negotiate it's removal as part of any settlement.
  • I have already tried and tired to get the default removed disputing it and agreeing to pay but they refuse to budge. I have worked in customer service escalated complaints department so i understand what exactly needs to be put in a letter and how to word it. I have tried every approach possible and they refuse.

    However, the amount has been paid today and I have been advised to inform the credit agencies ASAP and Halifax will provide us. Halifax don't consider phone contract defaults a serious problem compared to others due to the amount of people who receive them.

    I could get a mortgage myself but the amount would not be enough to cover the property due to my income so basically I need his income to complete it.

    It looks as though we are all clear to go now :) and thankfully the property wont be released until Aug/Sept as we are purchasing the show house flat.
