csa and ISA'S

Hello can anyone tell me can the CSA take into account an active isa account when working out arrears ?
I have searched the net and cant find an answer,thank you

    I am unsure ow you think they are linked. If the CSA state there are arrears on a case then they will expect them to be paid. This could either be in one lump sum or by installments. Arrears are not worked out on savings.

    Hi i am asking on behalf of a friend ,she is owed maintanance and her ex is telling the CSA he hasnt the money to pay arrears but she knows for a fact he has £5000 in an ISA.

    Ah ok. I see what you mean now. I dont know where the CSA stand on collecting arrears from a savings acc. She can tell them she suspects he has the money. They can ask for it in a lump sum, but more often then not a payment plan lasting no more then 2 years is set in place. If the NRP parent refuses to pay CM/arrears then the CSA could impose a DEO (if the NRP is employed) and collect a maximum of 40% of net pay each week.

    The CSA can access any account they like after a liability order has been granted by a court.

    However, if the address is different to his home address then it will never show up on a financial search by him, and it is very unlikely that he would ever of given the details or paid the CSA from that account.

    Unless your friend has the account details to pass on then you are probably fighting a losing battle (unfortunately).

    So long as the account is in his name it will show on an experian report, and the CSA access credit searches routinely, so they will find out the account details easily enough.

    Do you know how much the arrears are, and whether there's an assessment currently in place? The ISA would only be considered if it was earning enough interest to be classed as a source of income, if it's only £5k then it won't be. If he has a current assessment then the CSA will look to collect any arrears in line with that, however if he is either on benefit or not working then they'll not be able to collect any arrears currently so wouldn't even look at his savings.

    And held at the same address as all your other accounts. And i know loads of people who have accounts at different addresses. My father for example has accounts at 5 different addresses. And there are loads of people with exactly the same name, so very hard to attach an account that is held at a different address in my eyes. But then the CSA are a law unto there own.

    The CSA can search by name and DOB, and that will show the accounts and addresses registered.

    Which is why they have taken money from people who have never had dealings with the CSA... ;)
