PEDIGREE JUMBONE CHRISTMAS "OM NOM NOM" ON-LINE COMPETITION
- TERMS AND CONDITIONS (including minor clarifying amendment at (2) and (5) made on [8 December 2011] – in [red]
1. Entry is open only to UK residents. Directors, management and employees (and the immediate families of directors, management and employees) of the Promoter or the agencies or companies associated with this competition are ineligible to enter.
2. To play, simply:
- Accept the facebook pre-authorisation screen (If the user has previously authorised the application, they will not see the pre-authorisation screen again)
- Watch a demo video, or click to start the cracker-pull
- Play the cracker-pull with the dog - the user’s mouse cursor will become a hand. The user has to pull backwards and forwards against the dog until the cracker breaks
- Depending on the sequence loaded, the sequence will either end with the user winning, or the dog winning
- If the dog wins, he will chew on a Jumbone as his prize, as part of the video sequence. The user will get a message saying they have lost and on screen they will see one consolation prize: a randomly selected ‘cracker-style’ bad joke, and a link to a twibbon ‘party hat’ creator (offsite link to twibbon.com) [twibbon ‘party hat’ creator no longer available]
- If the user wins, the user is presented with the message ‘you won’ and they will receive a randomly allocated prize, either physical or digital
- If the user has won a physical gift, they are required to enter their fulfilment details. A user is able to tick an opt-in box to subscribe to future email updates from Pedigree. If the user receives a physical gift, they are asked to provide their email address and postal address for gift fulfilment. The user is able to return to the page at any time within the next 12 hours to complete their fulfilment details. If a user returns within 12 hours, they will still have the gift they were originally presented with. If the user does not complete their fulfilment details within 12 hours, the gift is returned to the allocation, and the user is no longer able to access their physical gift, and is offered a digital gift instead. If the user returns to the application after their prize has been de-allocated, they’re offered a digital prize by default.
3. The Promoter reserves the right to amend, modify, postpone or withdraw this competition at any time without notice.
4. The Promoter accepts no responsibility for late, incomplete, incorrectly submitted, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.
5. 6. Pedigree will aim to deliver prizes before Christmas but will be using Royal Mail and thus take no responsibility for late deliveries.
7. The competition begins on Tuesday 6th December and ends at midnight 24:00 on Friday 16th December (“Promotion Period”).
8. However the campaign activity on the We’re For Dogs, Pedigree, Facebook page will continue to run beyond the specified “Promotion Period” as outlined above.
9. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
10. The prize is not transferable or exchangeable and cannot be redeemed for cash or any other form of compensation. If for any reason a prize is not available, the Promoter reserves the right to substitute another prize for it, in its sole discretion, of equal or higher value.
11. If an entry is deemed not to comply with these conditions of entry, the Promoter has the right to discard it, regardless of the stage that entry has reached in the competition.
12. The promoter is Mars Petcare UK Limited (the ‘Promoter’) whose registered address is Freeby Lane, Waltham-on-the-Wolds, Melton Mowbray, Leicester LE14 4RS ("Mars Petcare")
13. These terms and conditions are governed by English Law and shall be subject to the exclusive jurisdiction of the English Courts.
14. Unless express consent is given by the entrant for use of the personal information for marketing purposes, the personal information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. However all personal information will be deleted once the prizes have been sent and will not be used for any purposes outside of this promotion.
15. The application uses a combination of the expected number of users to the campaign, the number of available prizes and seeded random number generators to decide whether a user is selected to win a physical or digital prize. Each user is entered into a randomised lottery which decides what prize might be available to them, and then passed through a probability filter based how many items of that particular prize are available to select whether you win a physical or digital gift. The gift allocation is not based upon skill or other externally influencing factors. I'm confused, it told me I'd won a digital download but then asked for my dog's name, her size and my postal address. My daughter won a download too and it just went to a download link so not sure if I have won a physical prize or not - I guess I will find out :-)0

I'm a bit disappointed, and so will my dog be.
I won one of the 100 doggy bags with a toy, treats etc. The gift arrived today. No doggy bag, just a dog chew.
