3 DCA's chasing same debt??

Hi,

Got 3 DCA's chasing the same debt. The original creditor wont speak to me anymore about it and have 3 different DCA's chasing for it.

Had an arrangement with the first one for a payment plan and then the next day received a letter from another DCA for the same debt. Spoke to the creditor who were confused and said it was still with the first DCA.

Anyway, got another letter from a third DCA chasing the same debt and also threatening a CCJ.

Where do I stand?? surely this isnt right??

    No, it isn't right - in fact its against the OFT debt collection guidelines - see here - OFT Debt Collection & letter Guidance - READ IF YOU ARE BEING HASSLED UNFAIRLY which you might want to quote to them - particularly 2.6c but they've probably broken others as well (DCAs usually do).

    It can happen than DCA will appoint a separate doorstop collector or similar or use a solicitor as well as writing themselves but if you have an arrangement in place with DCA 1 then either ignore the others or write back and complain.

    You're in with the Tessera group in Southend - Fenton Cooper, Rockwell and ELS & Cole - all the same group. But distinct from Moorcroft so I would guess that Moorcroft are no longer involved.

    Its not a case of not paying the debt as I am trying to, but I want to make sure I pay the right DCA! No point paying one DCA who isnt responsible for my debt as thats just throwing money away!

    Moorcroft still believe that they have it, but its interesting about the other 2. How do they get away with practising like this?

    I have had a case recently with Fenton Cooper so I know that they do provide sensible replies to queries. But you know what answer they will give - you should be paying us!

    I am wondering if Tessera have bought this debt from the original creditor and somehow Moorcroft have been left uninformed. Have you had any letters that talk about the debt being 'assigned'?
  • Nope, no letters to say it has been re-assigned. As far as Moorcroft are concerned they still have the debt.
