Lender hasn't provided CCA

Hi, I have asked Blair Oliver & Scott for a copy of my CCA for a Halifax debt they are pursuing. They haven't provided it yet are still sending me threatening letters.

I presume they're breaking some law by doing this - can anyone suggest what I do?

    It would not be illegal but would make the debt unenforceable if they were ultimately unable to do so at court.

    Not all debts are regulated by CCA agreements too. Overdrafts are one example.

    You are on think ice if you are hoping to get out of debt by denying you ever took it - there may be other ways they can prove it too - for example payments made from your current account.

    Not trying to get out of it - I have no reason to believe the debt even exists and although I have written to Halifax several times about it they have ignored my letters and now passed it to BoS

    I have a sneaky suspicion that Blair oliver scott (BOS) is a cunningly disguised (not!) department of bank of scotland (also BOS) who own Halifax who are their collections department.

    I suggest you send a formal letter by recorded delivery asking Blair Oliver Scott to provide you with the CCA or proof this debt is yours and if they cannot do so report them to the police for harrassment.

    Blair Oliver Scott are a collections firm - but it is confusing because they are stated as a solicitors - who knows

  • Blair Oliver & Scott are the 'internal' debt collection agency for HBOS. Before it was required to divulge who each DCA 'belonged' to it was the norm to set up an internal dca before passing out to the external ones.
