These conditions of participation apply to the “2 Million MINI” prize draw. As the organizer, MINI (BMW AG) reserves the right to decide on all issues not provided for by these conditions of participation.
1. PRIZE
One MINI - the 2 millionth - can be won in the “2 Million MINI” prize draw with the following configuration:
The ultimate configuration of the winner’s car (incl. color, equipment, engine power) is at the sole discretion of MINI (BMW AG), and depends on the applicable laws in the winner’s country.
The prize will be delivered in the winner’s country. Liability for compliance with a particular delivery date or delay in delivery is hereby expressly excluded.
All costs incurred in picking up the winner’s “2 Millionth MINI”, as well as all consequential costs (taxes, fuel, repairs, etc) shall be assumed by the winner and are expressly not included in the prize. The warranty regarding the winner’s “2 Millionth MINI” is exclusively based on the legal provisions in the winner’s country.
2. PREREQUISITES FOR PARTICIPATION
The “2 Million MINI” prize draw is not available in all countries, because legal guidelines exclude people from participating that live in Belgium, Norway, Sweden and India. The participating countries will be determined when the competition entries are processed.
The “2 Million MINI” prize draw is an online contest only, which is conducted via the MINI Wall of Fans Application on Facebook/MINI.
In order to enter the prize draw, participants must submit his/hers Facebook profile picture to the MINI Wall of Fans and have read and accepted the terms of prize draw, terms of application and privacy policy.
Participants must also either be or become fan of MINI on Facebook. Using the Facebook sharing function, participants can share their posts on the Facebook network. This only occurs with the express consent of the participant.
The prize draw has no affiliation to Facebook, nor is it sponsored, supported or organized by Facebook. The sole organizer of the prize draw is MINI (BMW AG). The recipient of all information provided by the participant regarding the Application is not Facebook, it is solely MINI (BMW AG). All information provided is only used for the purposes of administering the participation in the prize draw. Facebook is indemnified against all liability in connection with the prize draw.
Persons of full age who reside in a participating country are eligible to enter the prize draw.
3. PARTICIPANT’S LIABILITY
In case of any infringement of the guarantees made by the participant as to rights and lawfulness, the participant shall release MINI (BMW AG) from any and all claims asserted by third parties against MINI (BMW AG). The participant shall support MINI (BMW AG) in a legal dispute in all respects and bear all necessary legal costs and expenses (including court and lawyer fees). This is without prejudice to MINI´s (BMW AG) right to demand damages.
4. ELIGIBILITY TO WIN
Employees of MINI (BMW AG) and other companies belonging to the BMW Group, as defined in §§ 15 AktG, including project partners and their families are excluded from participation.
MINI (BMW AG) reserves the right to exclude individuals from participating in the prize draw in the event that these conditions of participation are violated. Most especially in the event that a submitted profile picture contains illegal content and/or violates the rights of third parties.
Participants who have provided false personal information or made use of illicit resources or who have otherwise gained advantages through manipulation will be excluded. In such cases, MINI (BMW AG) reserves the right to deny the winnings and demand their return, even retroactively. In the case of revocation on the consent with use of the data according to the privacy policy the eligibility for the prize draw will be cancelled.
5. CONTEST PROCEDURES AND PROCESSING
Contest entries will be accepted from June 27 11:59 a.m. (GMT) until August 29 at 11:59 a.m. (GMT). Each participant shall be entitled to participate once only in the prize draw. The winner will be selected among all participants by draw.
Once the deadline has expired, the winner will be notified via email. MINI (BMW AG) is entitled to transfer all participant information to the company that belongs to MINI (BMW AG) in the winner’s country, for the purpose of making the prize available to the winner. Also, MINI (BMW AG) is allowed to publish the winner (name and profile picture) on Facebook and MINI websites including the MINI Youtube Channel.
The winner determined by MINI (BMW AG) will likely receive the “2 Millionth MINI” within 12 weeks of receiving notice that he/she has won. Entitlement to the prize “the 2 Millionth MINI” shall expire if the winner does not respond within 12 weeks as of the sending of the notification or announcement of the pick-up date by the market or car dealer providing the prize, in which case a new winner will be determined by MINI (BMW AG) by draw.
MINI (BMW AG) reserves the right to examine the winner’s claim for entitlement and to modify the configuration of the “2 Millionth MINI” without stating any reasons and without prior notice. The prize cannot be exchanged for cash or for another prize. Any recourse to courts of law is excluded.
6. EARLIER TERMINATION OF COMPETITION / CHANGES RESERVED
MINI (BMW AG) shall be entitled at any time to terminate the competition early (e.g. due to technical or legal problems) without indicating the reasons or to change the conditions of participation.
7. DATA PROTECTION
In order to participate on the MINI Wall of Fans, participants must sign up for Facebook and/or become fans of the MINI page. By registering, participants declare that they give their express consent to MINI (BMW AG) storing the necessary information (first name, last name, address, E-mail, country, city) in connection with administrating the participation in the contest and transferring this information to the company that belongs to MINI (BMW AG) in the winner’s country, who may store this personal information during the contest period. Any further use of the participant’s personal information will not occur without their express prior consent.
The operator of Facebook and the participant have the sole responsibility for registration on Facebook. MINI (BMW AG) explicitly excludes all liability for claims, also in connection with data protection regulations.
8. LIMITATION OF LIABILITY
Unless provided for otherwise below, MINI (BMW AG) shall only be liable in case of willful intent or gross negligence. The above limitation of liability shall not apply: (1) in the event that material contractual duties are breached, (2) in the event of death, physical injury or injury to health, (3) in the event that warranty for a certain quality has been given, (4) in the event of mandatory liability under the Product Liability Act and (5) in the event of other mandatory liability. Compensation for damage arising from the breach of material contractual duties shall be limited to the typical foreseeable damage, except for liability based on willful intent or gross negligence or death, physical injury or injury to health or warranted quality or on product liability reasons. Material contractual duties, as arising from so-called cardinal duties within the meaning of regular court practice, shall mean obligations that make it possible to duly perform the contract in the first place and on whose fulfillment the participant therefore relies and may rely.
9. MISCELLANEOUS
The law of the Federal Republic of Germany shall apply exclusively. Should any of these provisions be or become invalid, the validity of the remaining conditions of participation shall not be affected.
