Im with them for one of my smaller debts. CAB worked out I should pay them around a £1 but the min they would accept was £5 pm so I agreed to that and have not missed any payments.
Today I get a letter to say they will increase my payments to £10 and can I return the DD form (think I pay by SO so dont think so!!!)
Phoned them and the guy I spoke to was less than polite!!!!
Explained was paying more than was deemed I could afford at last financial statement and as my income was now less, I certainly could not afford to double the payments! Told me would need an updated inc/exp then, explained would be doing that in Jan at the CAB as they said need to see what the pattern of my varying income is. He just wouldnt have it and insisted that I pay £10 as of Dec. In the end told him that would pay £10 if I had it on the said date and if knew I wouldnt would phone a few days in advance to discuss. Made it clear that I was in no way agreeing to this being my monthly amount from then on and this was a one off payment until could supply new inc/exp in Jan. Reminded him that was not trying to avoid paying debt but could not afford any more.
There is no way Im setting up a DD so they can keep taking £10
I know he was doing his job but doesnt mean he had to be so curt with me!

Don't worry about it, they are all like that.
You should certainly not set up a DD mandate with them but keep paying by SO.
If CAB has worked out you can pay £1 then that is all you should pay. I think you made a mistake agreeing to £5. Once your I&E is done in Jan you should pay the amount it tells you to and no more. You might think you can afford a few pounds extra, and you might in the short term, but you should have put those extra £4's away for emergencies or towards stuff that is paid yearly.

I have to agree with Xbigman on this one. Ignore the phone monkies all together and only pay what your I&E says you can afford. If it is only a £1 then its only a £1.
If Moorcroft were stupid enough to take you to court, in all likelyhood the judge would dismiss the CCJ claim as your already paying what you can. So tbh Moorcroft don't have a leg to stand one. Your in control of the situation, not them, don't let them bully you.
My advise is to stop dealing with them by telephone. I have 11 creditors and I run my own self-managed DMP and have done for a year and a half. All 11 of my creditors I deal with purely by letter for legal reasons. I have not spoken by telephone to an actual creditor for about 9 months.
You can ask them (Moorcroft) to remove your telephone number from their records and to make sure all correspondance is in written format only. If they then go on to break this arrangement you can complain and claim that they are harrassing you under The Administration of Justice Act 1970.
As soon as you flex your legal rights muscle, then Moorcroft will back off.
If you need a hand with writing an appropriate letter, please let me know.0 -
Moorcrofts system is set up to au6tomatically send out a revised payment letter every 6 months with £5 added onto the monthly payment. This was told to me by a nice Moorcroft advisor (if there is such a thing?)
I have 3 accounts with them and this happens with each one every 6 months.
I usually just ring them up and explain that I can't pay any more than I am already and usually they accept that, however the last time I must have got the same person as you as they wouldn't take no for an answer, in the end I told him I wasn't continuing the conversation and hung up. I rang again a few days later got someone different and it was all OK and my payment remained the same.
Don't let them bully you into paying more than agreed and more than you can afford.

To be fair I phoned them in response to a letter aboutthe increase in charge. Must get my printer software sorted so I can use it again and I will write to them in future!
Thanks for all the advice given ....... think I need a sticker on my phone that says "do NOT speak to creditors!!!"Orignal debt £31k 2005; reduced to just under £27k Sept 2008 New debt: Capital One Card £1000; mortgage arrears £1,252
