Capquest for someone else's debt - Now statutory demand

hi, i'm new to this so please bear with me!! We 1st received a letter from Capquest at the end of January, right address, wrong name (although same surname), to start with i just sent it back saying R.T.S. addressee not known at this address, got another letter in February again sent back, had 3rd letter on Monday so opened it to see what it actually was - have sought advise from Consumer Direct & have drafted a letter saying that the said person has not & does not live here & that no loans have ever been taken out with the said bank they are referring too, & that we do not expect to receive any further correspondence from them by either letter or phone call (i received a phone call from them today - don't know how as we are ex-directory), thing is as we share the same surname as the person they are looking for, should i put my name to the letter i'm about to send? (printed - not signed). Thanks in advance of any helpful advise given.

    I really, really wouldn't send them a letter. I know exactly what you are trying to do but it'll have the opposite effect and they will chase you harder. When they call for the imaginary person simply say what you keep saying "never heard of them" or "don't know anyone called that" or "think you've got the wrong number" and send the post back RTS some more. It's a pain in the rear but there is NOTHING AT ALL they can do to you, except annoy you. They can't take YOU to court, because You aren't even on the debt, they might as well take ME to court for it. Treat it will the contempt you would treat it if they were asking for Donald T Duck instead.

    PS: If your name is Hannah Duck I have really messed the example names up haha!
    I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
    (Ok, one of them is powerless, spiders can be nasty.)


    As of the last count I have cleared

  • hi thanks for that, we have received through post today a statutory demand for the named person, should i still ignore or still send letter & instead of puttin gmy name to it just put 'occupier of address'? thanks

    Please start your own thread. Statutory demands are serious and need sorting out.

    I would suggest you start a formal complaint with Crapquest and make a formal complaint to both the OFT and the Information Commissioner. MAke sure Crapquest know that you are compLAINING

    1. That they are pursing a debt related to someoen at your address when they know that you are onot the debtor and they know that the debtor does not live there.
    2. That they have divulkged details of another person's financial situtation to you.
    If you've have not made a mistake, you've made nothing
