well if he goes bankrupt, the OR is going to ask all these questions and more, bankruptcy is not just about getting rid of debts it is an investigation as to how they occuredHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
Please note that any views i put forth are not those of my former employer The Insolvency Service and do not constitute professional advice, you should always seek professional advice before entering insolvency proceedings.0 -

If he files with the Tribunal Service it shouldn't cost him a penny. The CAB have a list of solicitors who will give a free half hour of advice in such cases, that's usually enough for the individual to then know what to put on the Tribunal forms. When I joined, I needed a name. She sacked him just under 2 yrs ago he has been fighting his divorce and financial case since would he still be elegible to this after this period of time as he had to drop it then due to the costs that would have been awarded were as much as fighting it and he could not fund it due to having no job because she sacked himThe average woman would rather have beauty than brains,

Ah, I didn't realise it was that long ago. Unfortunately the time limit will have expired by now.
Is he fighting the debts on the basis of cohersion and being forced to sign things under duress?
This must be so stressful for you both, I do hope you get some resolution soon. When I joined, I needed a name. The forum members gave one to me...I am INAN

he is paying payments on the debts but the debt companies have been very cooperative so that is a relief but final resolution is being dragged out all the time by his ex her intention to make him bankrupt it is very stressful as the battle is against people who think they are above the law and try to demonstrate this by encouraging her solicitor to delay things and forget to take information to the courts thankfully the judge can see this is the case but in the meantime we are living on a knife edge as to whether we can afford to take this all the way to another 2 hearings if not we will become homeless and bankruptThe average woman would rather have beauty than brains,

Sorry to hear about your situation

If he doesn't owe money to his ex I don't think she can make him bankrupt. Its possible for the creditors [the companies he owes money to] to do it - but its unlikely to happen (generally it won't be worth them bothering - unless he had a lot of assets and income and wasn't making payments which doesn't sound like the case), and as you say they've been cooperative.
Even if he can't make the miminum payments, there are other options besides bankrupcy he could go for (if the court case is unsuccessful and he can't get the ex to pay them back). It would be worth him calling one of the debt charities for advice on this.Only after the last tree has been cut down,

Only after the last fish has been caught,
Only then will you find that money cannot be eaten0 -
