1. This Promotion is run and administered by Cisco Consumer Products Pte Ltd., a Singapore corporation having its principal place of business at 3 Bishan Place, #06-03 CPF Bishan Building, Singapore 579838 ("CCP" "we", "our" or "us").
2. The Promotion shall begin on 11 February 2011 and entries must be received by no later than 14 February 2011 (included). We reserve the right at any time to discontinue this Promotion, with or without notice, in each case without liability or penalty to CCP.
3. We may change these terms and conditions at any time and such changes will be communicated via the 'Terms and Conditions' section within the 'Love Flip' application and will enter into force immediately. Your continued participation in the Promotion will constitute your acceptance of these changes. If you do not agree with the terms and conditions at any time, you are free to cancel your participation in the Promotion by uninstalling the 'Love Flip' application.
4. The Promotion is open to anyone in the UK aged 18 or over ("participant" or "you"). You can enter the Promotion through the 'Love Flip' application on the Facebook Platform. You can also find the application on the 'Love Flip' tab on the Flip Video UK Page on Facebook. The Promotion is not open to employees (and/or any relatives) of CCP, Cisco Systems Inc., any contractors or agents of CCP or Cisco Systems Inc., or anyone professionally involved in the administration of the Promotion.
5. By participating in the Promotion, you hereby consent to these terms and conditions and to the terms of CCP's privacy policy, which you can find at http://www.cisco.com/web/siteassets/legal/privacy.html.
6. You hereby agree and accept that the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook and you hereby agree to release Facebook and its affiliates from any liability arising under or in connection with the Promotion.
7. Subject to Sections 8 and 9, CCP's total liability to you for any loss or damage arising in connection with this Promotion shall be limited to the suggested retail price of one (1) Flip Video camera of your choice.
8. In no event will CCP be liable to you for any lost or damaged data (including, without limitation, the loss of or damage to any user content), lost revenue, income or profit, loss of the ability to use any third party products, software or services or for any special, indirect, consequential or incidental losses, or punitive damages, regardless of the theory of liability (including negligence), arising out of or related to the Promotion, even if we have been advised of the possibility of such damages. REFERENCES ABOVE TO "SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL LOSSES" SHALL MEAN ANY LOSSES WHICH (i) WERE NOT REASONABLY FORESEEABLE BY BOTH PARTIES, AND/OR (ii) WERE KNOWN TO YOU BUT NOT TO US AND/OR (iii) WERE REASONABLY FORESEEABLE BY BOTH PARTIES BUT COULD HAVE BEEN PREVENTED BY YOU SUCH AS, FOR EXAMPLE (BUT WITHOUT LIMITATION), LOSSES CAUSED BY VIRUSES, TROJANS OR OTHER MALICIOUS PROGRAMS, LOSS OF OR DAMAGE TO YOUR DATA OR YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE.
9. NOTHING IN THESE TERMS SHALL LIMIT CCP'S LIABILITY TO YOU FOR ANY DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OR FOR ANY DAMAGE CAUSED BY OUR FRAUD OR FRAUDULENT MISREPRESENTATION.
10. We hereby disclaim all liability in respect of any loss or damage arising from the loss of an entry or failure to register an entry as this is beyond our control.
11. You are free at any time to cease your participation in the Promotion. You can do so by uninstalling the application.
12. If you fail to comply with these terms and conditions, we reserve the right to cancel your participation in the Promotion.
13. No purchase is necessary to participate in this Promotion and entry is free of charge.
14. If any part of these terms is disallowed or found to be ineffective by any competent court or regulator, the other provisions shall continue to apply.
15. We reserve the right to disqualify and/or cancel any illegible, incomplete or altered claims.
16. To enter the Promotion you must either: (a) click on 'Love Your Flip?' and register your existing Flip Video via the 'Love Flip' application, thus entering you into the prize draw or (b) click on 'Love to win a Flip?' and enter the prize draw. The prizes available under this Promotion are: 34x Valentine's Day Flip Video UltraHD camcorders and one weekend (Friday to Sunday) trip to Paris for two people up. The winner(s) will be selected randomly by CCP. CCP's decision as to the identity of the winner(s) is final. The winner(s) will be notified by email within thirty (30) days of end date of the Promotion. Our decision regarding the allocation of prizes is final.
17. The trip to Paris is for two people and includes: return Eurostar tickets from London to Paris and two night's accommodation including breakfast. Time of travel is subject to availability. The winner will be selected randomly by CCP. CCP's decision as to the identity of the winner is final. The winner will be notified by email within thirty (30) days of end date of the Promotion. Our decision regarding the allocation of prizes is final.
18. If we have notified you that you have won a prize, you must send us an email to claim the prize, giving a valid UK postal address. Any unclaimed prize by 31st March 2011 will be forfeited and will not be eligible for compensation.
19. Upon receipt of the email referred to in Section 18, we will arrange shipment of the prize within the UK, within a maximum of sixty (60) days from the end of the Promotion.
20. You are responsible for the payment of any and all taxes (including any increased individual income or other tax or national insurance liabilities), duty, national insurance and/or licenses and or other fees or costs that may apply to you or that may arise under or in connection with the receipt of any prize. For any prize that involves travel, you are responsible, at your own cost, for obtaining all necessary documents including valid passports, visas, as well as travel insurance. You are also responsible for complying with all health, safety, travel and other government regulations and advisories.
21. We reserve the right to withhold sending a prize and/or reject and cancel the Promotion entry of any participant who we reasonably believe has breached these terms and conditions or who we reasonably believe has cheated, deceived, or disturbed the Promotion in any way or attempted to do so. We also reserve the right to pursue any participant who has breached the terms of the Promotion or who has otherwise cheated, deceived, or disturbed the Promotion in any way or attempted to do so.
22. The prizes are non-exchangeable and, in the case of any intangible prizes, non-transferable. Prizes cannot be attributed to other people. No cash alternatives to the prizes will be offered. Prizes do not have to be accepted. Prizes returned for any reason due to problems relating to the name or address of the recipient will not be re-allocated or returned and remain the property of CCP.
23. All prizes are subject to availability. Where permitted by law, we reserve the right to offer alternative prizes of equal value, should the original prizes become unavailable due to circumstances beyond our control.
24. By participating in this Promotion, you hereby grant CCP, its affiliates and its agents permission, without further compensation, to use your name, likeness, photographs, film, video, voice recordings and image for the purpose of promoting Flip Video and/or any CCP products or services.
25. The laws of England shall apply to this Promotion and any dispute that cannot be settled amicably between CCP and you shall be referred to the courts of England.
