CCJ - No contact from creditor after 5 years!

Hi all,

Some advice if possible please? I received a CCJ and High Court Judgment for monies owed due to personal guarantees in a failed business venture almost 5 years ago. My whole family who were business partners went bankrupt, but due to having no assets they have opted to give me a CCJ and HCJ. After almost 5 years since the Court approved the CCJ and HCJ, the two creditors have not made contact with me. How long does a CCJ and HCJ stay on my file and will I have to apply to the court asking for them to be removed after that time if the creditors have still not made contact with me?

    The CCJ will stay on for 6years from the date of judgement - it will then go automatically irrespective of whether its been paid. I would guess that HCJ is the same - but I don't know.

    They could still contact you later at any time to repay the CCJ - but once 6years have passed they have to go back to court to get permission again to enforce the debt (again this is for a CCJ but I would think that HCJ might be the same).

    Did you go BR as well?

    Any debts would be statute barred after 6 years if no payment has been made and you have not done anything to admit the debt.

    Sorry chippy, debts with CCJs don't go statute barred :(
