I'm charging Platform Home Loans MY £40 admin fee

Hi All,
Year on year platform home loans write to me for a copy of the insurance schedule for 2 houses that I have. I fax them the full insurance schedule which clearly states cover for both houses and that Platform Home Loans is an interested party.

They DO NOT read the insurance schedule properly so they write to me again to say their interest is not noted and they will charge me £40 admin costs. So I call them up, ask them to read the insurance schedule properly as it definitely notes them as an interested party.
After a week I get another letter to confirm that insurance schedule is acceptable and £40 fee is waived and refunded - no apology from them of course.

Naturally because they are so useless, they contact me again to say that they are still waiting for an insurance schedule for the other house that is mortgaged with them. I'm on the phone again to explain that insurance for both houses were on the SAME insurance policy. A week later, another letter comes to say that it is acceptable - no apology for this either.

Now this scenario happens every single year. On top that, for the past 3 years I have been telling them verbally and on my written correspondences that they have the address of the house wrong but they have not bothered to rectify it yet. I am absolutely fed up with them.

This year, for MY time I'm going to write and charge them MY admin costs of £40. If they refuse to pay can I take them to a small claims court? Or what can I do to make them pay?

I would appreciate your advice and thank you so much for reading this long winded post (I'm just reading it back now and it's quite an essay!!)

    Send all correspondence by a signed for service and keep copies.

    Then let them pursue you through the courts. I',m sure it'll give them a wake up call by letting them waste their own money.

    When you fax your schedules to them next year fax a covering letter with something to the effect of...
    Here is my policy schedule confirming that Platform Home Loans is an interested party in both houses referred to in the schedule.

    From this year I will be charging a £25 administration fee for each and every telephone call or letter that has to be sent by myself with regards to the above matter.

    Any correspondence which does not confirm the schedule is acceptable will be deemed as acceptance of these terms and conditions.

    Oh for the day that any contract a company sets up creates an automatic mirror one with the consumer having exactly the same clauses as the company.

    I don't believe such a term would be enforceable under contract law.

    Possibly not but when I tried for for 6 months to have a credit card closed (after closing it it somehow gained 4p interest somewhere) by phoning the call centre (numerous times) and writing (twice), I wrote a letter to what was then Goldfish with similar wording and had a very nice letter back with the problem sorted and the card closed.
