Help! A bailiff is at my door!

I have applied for an admin order and a bailiff listed on the order is at my door. I have a CCJ and this is listed on the admin order but I have just rang the court and they have said that they have a back log and mines next in line to be done. He is sat in his van now and he has put a lean on my car which is on finance. Can he take my car? What can I do as the admin order isn't in place yet even though I took the form in 2 weeks ago?!:eek:

    If the car is on finance then he can't levy on it because it doesn't belong to you.

    Whatever you do, don't let him into the house. Talk to him through the letterbox if you have to talk to him at all.

    What exactly are you waiting for the court to do? We need to know what point in the process you're at.

    Is the bailiff there for a consumer debt (credit card, loan etc) or is it council tax or a fine?
    Unless I say otherwise 'you' means the general you not you specifically.
  • First I'll say thanks every1 for replying. I am waiting for the court to process my administration order. They are writing out to each company listed on it today (so they say). The debt is for a ccj which is for a gas and electricity bill for £897 but the letter the bailiff just posted (cos I wouldn't open the door) says i now owe £1814.83!!! It says he's coming back and will remove goods even in my absence! I think he has now parked round the corner waiting for me to go out.

    Definately close all the windows etc and don't open the door to them. Hopefully you'll get all the advice you need soon.

    Basically, he's !!!!!!!!ting you.

    The fees he's allowed to charge are around £42 for two letters. If you don't talk to him and don't let him in then that's it. Certainly not about a grand!

    If you've never let him in then he can't remove goods. so make sure everything's locked and there's nothing he can do.

    You'll need to show him proof that the car is on finance, make a copy of the agreement and hand it to him through the letterbox.

    There's a process before bailiffs can get involved. Firstly, they have to get a CCJ. Then you have to fail to keep up to the repayments ordered by the courts. Then they have to go back to court. Has all that happened?

    Finally, are you sure he's definitely a bailiff? Sometimes they act as debt collection agents as well but push the bailiff thing to scare people.

  • He won't fit through my windows - thank god and my doors are firmly locked. I've got 2 kids here who think were playing hide and seek! My OH will be back from work soon so I'll feel a bit better then. The lady I spoke to at Court has just rang me and told me to ring him and give him her details if he wants to confirm that I have applied for an admin order. Should I ring him? Feel like I''m going to be told off (weird)!
  • I got a CCJ and didn't reply in time. A bailiff came but I had already made an arrangement with Eon to pay £100 per mth. I made one payment late and it was for £80 (i was a bit short and planned to pay £120 the next mth which I told them about). They said I defaulted on the arrangement and said that I now have to pay the agents which are High Court Enforcement however the £280 (that I paid Eon direct) hasn't been taken off the bill.

    Feel like I'm being screwed. I only work part time and my OH is self-employed so work is very little at the minute!

    Hi Tinkstar, yes ring him and give him the details the "court lady" gave you. And tell him if he doesn't leave, you will call the police and have him for intimidation!!:mad: Damn these people!!
  • Just rang him and used the last of my credit (damn it). He said I WON'T ring any court for YOU. He didn't seem to understand what an admin order was and kept saying I still have to pay him so I told him I don't and that he isn't to contact me again and he said if they haven't received any paperwork by Monday he's coming back so I said I'll ignore him AGAIN!
