CCJ 'settled' on one credit report

I recently got my credit reports from Experian and Equifax. There is a CCJ against my name for a supposed overpayment of salary from years ago. I've always disputed that i owed the money and as far as i'm concerned i was paid what was owed to me when i left that job and no more. The company have yet to provide adequate proof that i owe the money all they've ever sent me is a word document with figures written in but never any pay slips or evidence to show that money has been paid to me in error.

Since the CCJ was entered in May 2009 the solicitors working for the company have written to me a couple of times demanding the money, i've always written back telling them politely that i don't owe it and they are yet to prove otherwise. When the case was entered i didn't receive court papers to appeal against it until after the judgement was entered. At the time i was confused and stupidly believed the solicitors when they told me there was nothing i could do.

Following advise i was given on a previous thread on here i had decided to write to the court to put in a late defence and write to the solicitors again demanding concrete prove that i owe the money. However one of the credit reports (Experian) lists the CCJ as settled, Equifax doesn't list it as settled. Should i contact the court to try to obtain a certificate of settlement? My plan would be to call them and say i have obtained my credit reports but only one is showing the account as settled so could they send a Certificate of Settlement to me so that i can get the other report updated.

Once i receive the C of S, i plan to contact the solicitors and demand they get the CCJ removed from my file as they have clearly settled the account because they know they can not prove i owe the money. Is this the best course of action to take?

    If you haven't settled it then I can't see that they will send a certificate of settlement.

    This sounds like a case where you want to get the CCJ set aside not get it shown as settled. Which is far better as it then shows as though it never existed.

    Have you tried to get it set aside? Info on national debtline website if you want to.

    Thats what i planned to do as it was suggested on the other thread. However as one credit report is already showing it as settled i thought that maybe the solicitors for the company have told the court it is settled because they realise that they can't prove i owe the money.

    Unless it is settled, the fact it shows as settled is probably an administration error. Settled or Not, the damage of the CCJ is done.

    If you do not owe the money, you need to get it set aside so it is removed from your file.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
