hi there,
please could you help me,
i am new to this and not sure how to post, i have a query similar to this one you helped with.
my parents have lived in spain since 2002 and have a couple of debts with capquest for egg and citi bank.
both are over 6 years old but they have been sent a letter stating they will start procedings for a statutory demand in 2 weeks.
Can they do this still and they do not even have the right address. They have never replied to any letters sent previous either.
Any help would be much appreciated, thanks

Is it over six years since they last paid or acknowledged the debt?Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

hi there,
thanks for replying, yes it is over 6 years since any payments or contact0 -
In which case this debt is statute barred and your parents are not required to pay.
Strictly speaking, Crapquest are allowed to ask you parents to pay, until they advise the blighters that the debt is SB. At which point, any furether attempt to get money breaches the OFt Rules on debt collection.
IF and VERY IF Crapquest try to bankrupt them, the only defence required is that the debt is SB, and your parents should hag Crapquest out to dry.
Crapquest are hoping that your parents do not know the law.

In that case the debt will be "statute barred". And so legally unenforceable.
There is info and a letter to send in this link.
