Capquest - I can't win

Hi Guys,

If possible I need a bit of advice...

I have a debt with Sainsburys Bank, which was passed on to Capquest. I fully acceapt the debt is mine, and am paying it back as best I can.

Since April I have been paying £120 a month by DD (with about £1100 currently outstanding).

Whilst at work this morning I get a call from them asking me to to pay more a month. I said I was unable to do this, and the rather arrogant woman on the other end said. If you do not send a list of all your outgoings and incomings we will no longer accept £120 a month. I am not willing to give her this info, and thats where the call ended.

I have in a previous letter to them asked them to remove ALL telephone numbers and only corrospond by letter. This is obviously not the case.

I don't have much money spare at all each month, and £120 is pushing my limit to the max.

So...

What do I do?
Cancel the DD?
Write them a letter?

I'm a bit stuck as what to do next, so any help would be appreciated.

Cheers

Whats wrong with competing an income/expenditure form? They have a right to ask and a right of proof of income but NOT a right of proof of outgoings (The same as courts).

Send them an income/expenditure and ensure that its now listed that you can pay what you can afford NO MORE! Do not stretch yourself and if £120 a month is stretching yourself, tough to them.

Oh right, sorry, I wasn't aware the Debt Collection Agencies had the right to my income.

Surely then, the courts would take a very dim view of Capquest not acceapting your SOA?

    And another comment!

CANCEL DIRECT DEBITS!!!!! Never pay by direct debit, as they *could* take what they wanted. Direct Debits work by them requesting their bank to deduct money from your bank and your bank accepting the request.

Always pay by Standing Order. This works by your bank paying money from your account to theirs on your say so.

Always pay by SO and stay in control. All you need is their sort code, account number and your account reference number.

Right, I've cancelled the DD, and written to them, saying that I wish to change to SO.

I also said I'll send the an SOA, and would they send a form. I also asked why they are calling me, when I specifically asked to be contacted by letter only.

Cool. Good start. And dont let them get to you! Its their job to grind you down!

You may have to pay the next instalment by cheque - you dont want to fall behind with payments but I am sure they will be to slow in sending you a standing order form.

Some of my DCA's (not used Capquest) supplied SO forms without any details on, expecting me to send it back to them first. I set up mine using my online banking and all sorted almost instantly.
  • CapQuest are the worst people I have EVER dealt with. As has been mentioned above, I was fully aware of my debt and had no problem with repaying it. However, they expected a payment that was ridiculous when compared with my weekly income. The phone calls I received from them were incredibly intimidating and resulted in me expecting a baliff on my doorstep the next day.

I recently transferred all my debts to PayPlan and they are now dealing with them on behalf. Strangely enough, now that they're dealing with someone who knows what they're doing, my £35 weekly payment has dropped to £5 monthly, all charges are frozen and I can sleep at night again.

PayPlan said that they will say anything to get the money out of you, its obviously better for them if the debt is paid off quicker.

Maybe you could take advice from someone who knows what they're doing. Its not a question of not wishing to pay back the money, its just that you need to survive as well!!

Good luck with them, I know exactly what you're going thro.

I'm not too wound up about it, but I guess it just annoys me, that they just can't leave me alone for another year or so whilst it's paid off reguarly each month.

As it stands they are getting approx 10% of my income each month. Is that about right? Or too high/low?

Do they expect you not to eat or something? Or even have a little bit of money for yourself?
