NRP's maintenance obligations

Hi, can anyone tell me if the CSA spell out all of the details in their annual maintenance report to NRP such as how they calculated the maintenance liability.

In particular, I'm asking if the shared care element is made clear, i.e.

'you have child 104 nights per year, therefore your liability is 'x' per week. I ask as I am awaiting a tribunal date centered around shared care dispute.

The ex is claiming the CSA never made his 'nights per week' clear in his maintenance breakdown a few years ago, and is trying to say that if the CSA had made it clear he would have argued incorrect 'shared care' years ago! Sadly, this appeal isn't for a great deal of money, but obviously it means alot to the ex to fight tooth and nail to avoid handing over any of his very precious money to his (obviously not so precious) daughter.

Also, is it possible the tribunal people will look at the 'evidence' and decide the ex doesn't have a case? He really doesn't, not if factual evidence is to be the basis of any outcome.

Thanks guys, if anyone knows any of the above, I'd appreciate it :)

Assuming you are on new rules, I can tell you that the maintenance calculation letter automatically issued by the system does indeed contain a statement of the number of nights shared care that has been awarded. It says something like (working from memory here so may not be accurate):

Your weekly maintenance liability is £70

£10 is deducted because you care for *child* for 52 nights per year

    You must therefore pay £60pw.

Sorry to say but my thinking of how the CSA operate at complaint level his complaint must have made an impact to them as he has been given appeal rights

Thank you miss bunbury, in that case, he doesn't have a leg to stand on. My ex is obviously trying every trick i the book to avoid accepting his responsibility. If the CSA are present during the tribunal hearing, I don't think they would take too kindly to being told they haven't done their job, when they have!

His appeal rights are being questioned, from what I gather from the wording in their letter with regards to evidence. I hope he doesn't get appeal rights only because I know that he is trying it on, and it costs us normal people who abide by the rules....money (tax money)

Thank you for your info, will let you know what happens. I think there is quite a back-log with the tribunal at the mo, unfortunately
