help with letter to court -house repossesion

Hello Guys :)

I am writing the letter to the courts today as my DH has to work ont he date of the court hearing.

We have already sent back the income and expenditure forms and have stated we do not contest the repossesion and we have found rented accomodation.

I have been adivsed to write a letter just stating to the judge that he cannot make the date (mtg in DH name only) and to expliain our financial difficulties.

My questionis... how much detail do we need to give about how we got into this mess??? Sounds silly but i cant imagine they will care too much if we say we dont want to fight it:o

    Dear Judge

    I am writing to inform you that I am unable to attend on 24/12/09 @ 12:30

    However we understand that the repo is the best option as I am now BR my ref number xxxx/2009

    yes i thought the simpler the better, could waffle on and on if i had to go through EVERY reason leading up to this point!

    As we are not yet BR i will just put we have been advised to go BR.

    As you are not BR yet, it doesn't matter if it is signed.

    It's only after BR that you should avoid signing anything that admits liability.

    I know what you mean about packing!!!! Its a nightmare!
    We have been here nearly 11 years, and although we haven't written to the Bank yet that we are allowing repossession we are actively searching for a rental. We have 2 in our sights - 1 is newly renovated but they are wanting us to jump thru hoops to get it and the other is only for 2 years as the lady is living at her sons while he is working abroad.

    I am starting to stock up on boxes (which is adding to the clutter Grrr:mad:) so as soon as we know which house we are moving to I can start getting stuff packed up and ready to go to the new house. We plan on doing it steady - then once this house is empty send a letter to the bank and tell them to repossess as we have vacated the property. (we went BR on 15 March).

    I'll tell you what frustrates me more than anything - waiting for others. I am not a patient person, but waiting for people to make up their minds really winds me ! :rotfl:

    Okay, now I am scared...

    I sent back a letter to NR saying that I wanted them to repossess the property, and I have now got a repossession case at the beginning of next month...

    But I signed the letter saying that I wanted them to repossess, although I did not admit any liability, just literally stated that I was bankrupt, the property was empty and please repossess.

    Can they shaft me now with the signature?

    one high street bank did this to me on a loan agreement "fraud" it was only due to personal circumstances that i didnt sue them for it.

    would keep a very clear copy of that letter for your own records.

    They would be real stupid to try this.
