    Hi, a diary is a very good idea, absolutely, I hve one myself and it does help. You sound identical to me and my DH! I'll 11 months to go until AD so i've been at the thick end of it too.

    When you fill out your BR paperwork it's meant to be as your circumstances are on the day but you'll be living in house limbo that day. I would write your mortgaged house on the paper but when you have your brief talk with the OR on the phone around the time of going bankrupt let him/her know that you are moving within hours and they'll make a note of it. I think that is the most sensible to do. Do others agree?

    My mortgage was with Northern Rock too. Firstly though the house is still your responsibility when you move out right up untill you get the confirmation from NR that they have taken possession. That means your still responsible for paying the council tax. Do not worry because there is a 6 month exemption you can get whereby you pay nothing over this period. Just let the council know and it will be fine.

    Northern Rock and vol rep. Right I have to be straight with you and tell you about my experience with the advisors that work for NR. They basically lie. I have been told many a tale to try to trick me into signing their paperwork to accept liability for any shortfall when it is sold. There's a lot of info on the board about vol rep and signing paperwork.. basically sign NOTHING they send you. NR were not bothered about handing keys back or anything like that. They just changed the lock. The main thing is to let them know via telephone (in my experience letters get lost.. hhmmm best to ring so they have to log the call.. dear oh dear.) that you want to vol rep when you're ready and settled in your new home. They'll tell you you can't without the paperwork and you may go round in circles for a while. The important bit is I managed to vol rep my haouse with a 1 sentance letter. Don't let them tell you they won't allow it ok, they will you just have to stand your ground about their deed of acknowledgement.

    I have a feeling I may have shocked you. I don't mean to - that company are slippery and I want to make you aware of it. It will all work out in the end. They took possession of our house within 3/4 months.

    When you speak to OR they'll advise the same, tell them you want to vol rep but don't sign their paperwork. yeah, it's up to you to get the house sorted and not the OR.

    There's a sticky about vol rep i'm sure and many many many of my back posts dated between August and October last year will expplain about my journey with Northern Rock. Hope to help and not send you in a pit of desperation! Just don't listen to their excuses or fibs.. You can vol rep wihout their paperwork being signed.     the reason I say this, if not just for your own peace of mind, is because a judge cannot make you bankrupt if you have not sought professional help, he'd still take you money and you'll be back to square one.

    If your house is in negative equity you may be able to keep it even if you go bankrupt. I'm not too great at the techincal side of BR, I only tell people of my experience but I can assure if you call one of those numbers things will fall clearly in your head and you'll feel less confused, really. I used national debtline, I found them to be fantastic, even sent me a pack all about bankruptcy to read.

    Thanks Don. I missed you comment the other day. Glad someones been the same place as i'm going. I'm going to get the advise service to check the forms for us as well. Its free so why not.


    Still waiting for the forms to come through the post from the courts. If not in the door tomorrow i'll print the form of the tinternet and fill them in.

    Just to keep you updated.

    Forms did arrive on Wednesday. Not yet took them out of envelope. I think its a weekend job.

    Phone calls continuing. Not sure what they think is happening at our house. Nobody they ask for is ever there.

    With the exception of Capital One. They rang with some mumbling idiot (teenager) on the phone asking for the Mrs by her first name only and i though it was her brother !!!! I laughed, but she didn't.

    Nearly all boxed up now ready for the move. Dad's borrowing a van from work. Its all happened a bit fast and we're starting to tire.

    It was 8 weeks away when we looked at the house. Now we start moving in on Wednesday !!!.

    Gotta take the cat run down this weekend. There not going to be happy as their indoor cats and thats their bit of freedom.

    Oh yeah its my birtday today. The big 33.

    Present = watching Lost tonight and looking forward to the final episode on Monday moring @ 5am. I'm a Lost-a-holic and i need help.
