Went to court last friday for house repo.
Arrived at 9.45am for 10.00am hearing. I gave my name to the usher who was surprised to see me! 'Not many turn up for these' he said.
He then said if I needed legal advice there was a duty solicitor avaialble. I was then introduced the to legal rep from 1st Plus.
She ushered me into an interview room and I thought the deed of acknowledgment letter was comiming -please sign here etc etc.
To my relief she only went through the deatils of the case I and that she would be asking the judge for a money order. I expalined that debt was part of my br order and I would be telling the judge the same.
We were then called straight in to the judge. He asked if I had any objections to the repo and that he would not seek a money order because I was protected by my br order.
He then asked if I needed time to vacat the property but because I am already out and in rented accom he gave a section 4 repo order?
He thanked me for coming and was out of the court building by 10am
Thats another hurdle out of the way. Just waiting now to hear about a possible IPA. I have not heard much from OR since the intial telephone interview in Feb. I emailed him details of salary increase and he replied carry on as before.
I was dreading the court hearing and coming face to face with someone I owed alot of money to, but with hindsight there was nothing to worry about. I was confident with the advice from the forum and that I knew my rights.
All the best

thanks for posting this, we will have to go soon to ask for more time to move out. if we havent gone bankrupt by then should i say we are or will the mortgage company get funny about this and pressure us to sigh something? also is there anything from that day that you have to sign?0

i wouldnt sign anything . without seeking legal advice first.0

I was not asked to sign anything on the day. The court sent a defence questionaire which I was asked to filll in and sign. I think this is for people who want to stay in the house or contest the repo. As always the advice from the forum is dont sign anything. I did not complete the forms but sent an signed letter back stating I that I wanted the repo to go ahaead.
Once the repo order has been made I beleive you have 28 days to leave the property.
