Debenham's Dilema.

Hi all, bit of a problem here.

I used to have a debenham's store card, which had a secondary card in my ex's name (the account was my sole responsibility though). This time last year I borrowed some money and paid it off in full, and asked them to close the account which they did.

At the end of last year, I got a phone call from them saying that I'd missed my latest repayment and that the card was near its limit (about a grand). As you can imagine that was quite a shock, so after some minor detective work I assertained that my ex had been using her card (despite us having been seperated for nearly a year and knowing full well she had no right to do so).

I confronted her, and she acted like I was out of order, and that it was her card and as long as she was making the repayments it was none of my business. I pointed out that the account was in my name, that she told me she'd destroyed her card over a year ago, and that I hadn't paid it off so she could start using it again.

I spoke to Debenham's and they said there is nothing I can do (as have the CAB), as although what she did is wrong, apparently it's not illegal. She's constantly late making these repayments, which affects my credit rating and has them calling me roughly 3 times a day.

What really annoys me is that although I asked them to close the account, and they said they had, they said that under their terms and conditions a deactivated account can be reactivated by simply using the card in any of their stores, and that it was my responsibility to ensure her card was destroyed. The thing is, I have the original agreement that I signed in store and it says nothing like that at all, so I'm wondering-is there anything I can do?

  • There wouldn't be any point to be honest-they know the situation, and they've blocked the cards from being used, I'm just more than a little annoyed that I'd paid the account off in full, was told it was closed down and then find I'm back in debt due to someone's dishonesty and some random clause that I'm not even sure exists.
  • Sorry for bumping my own thread, but I'm really hoping that someone can offer some insight. It just seems so unfair that she's effectively being allowed to steal from me and get away scott free, while I have to pick up a tab that I can't afford and shouldn't have to pay in the first place.

    you will need to take her to the small claims court, apart from that not really much.
