Debt collectors won't stop bugging us!

This is a post I made on 11th March 2009
I received a letter this morning addressed to a Mrs female person with the surname of my boyfriend not me. We've been in the house for 9 months. I do know of this person, she was married way back to a family member of my b/fs but they divorced years ago, never seen either of them since and neither of them ever lived here.

Its from welcott chasing a RBS debt of £700, they got the address from experian as a possible forwarding address. Apparently we shared a previous address (not true)

If it isn't their debt to contact them on an 0870 number.

So now what? We regulary send back "not known at this address" from the previous occupants but we are concerned about that a previous poster put about then ending up with no post at all even that which was addressed to them!

I have an experian membership and there is nothing untoward on there.

Any advice?

Following this my boyfriend rang wescott credit services and told them no such person lived here. They apologised and said they would not contact us again.

Then on 21.04.09 we received a handwritten white postcode from Wescot Credit services addressed to "The Occupier" asking us to contact them, again my other half rang and told them no such person lived here.

Then we received a couple of letters addressed to the original person again from Wescot - we just sent them back "not at this address". Then haven't heard anything else over summer.

Obviously the debt was then sold on..

20.11.09 Newman Debt Collection Agency sent a letter addressed to this person "URGENT ACTION REQUIRED"
"We regret to note the absence of a reply to our previous letter" - no letters have ever been sent from them!? Goes on to say due to lack of response it's been assumed the debtor falls into the "WON'T PAY" category.

"YOU HAVE 48 HOURS TO RESPOND AND AVOID ANY FURTHER ACTION"
So he rang again, and the person on the end of the phone could find no record on their system of the reference number we had been asked to quote, but my b/f told them no one of that name lives here or ever lived here.

"LEGAL ACTION"
Apparently we have "Chosen to ignore previous correspondence" and their clinet could issue "an attachment of earning order made to your employers" or "a Baliff to seize your goods"

and to prevent this we must
a) pay of the full balance or
b) a resonable offer of repayments.

It's makes me so angry which their threating tone, so ringing and telling didn't work, sending the mail back didn't work. I just want to yell down the phone at them for harrasing us for debt for someone who doesn't even live here! :mad:

Ideas? An added suggestion of getting the fury out of my system would be great too!!

    Ignore them, it's nothing to do with you and tell them if they contact you again you will whap a harassment case on them!
    They can't touch you as it's not your debt.
    These 'shark' firms will try anything to get their debt repaid, including dropping a line to everyone on the street asking 'do you know the whereabouts of Mrs X', etc.
    They're like robots, they don't see anything outside their 'script'.

    anyway , post this in the `debt free wannabbee` forum , the guys there will be all over it in seconds !!! :beer:
  • Warn them that you are going to do the following if they continue, and then if they do, invoice them for your time.

    £50/hr is a good starting point - I'm sure they'll stop pretty soon after getting the first one!

    Either here or on the consumeractiongroup forums you will find plenty of advice re DCA's. Rule one is to never call them back. All correspondance in writing etc.

    Ignore them, the is nothing they can do.
    For everthing else there's mastercard.
    For clampers there's Barclaycard.
