6 year ruling on IVAs's

Can anyone help me, back in 2002 we took out an IVA to effectively "take care" of a mountain of debt we had accumulated.

After one month payment, we spilt up from our marrige, due to this i cancelled the payments from the joint account we had. over a period of time we got back together, however I/ we never received any further correspondence regarding the IVA.

My questions are

1. Would the IVA come under the "6 year Ruling"?
2. If not would any of the debts under the IVA fall into this ruling?

I hope you can help, as we are now considering bankruptcy!

    Did either of you move to another address when you split has any paperwork been redirected? Could you try checking on your credit report for it. I would be loath to contact the actual people who arranged the IVA but have a look on the insolvency register online to see if your names are there, its free.

    Thanks for that we have checked the register and neither of us are on it?

    I also believe that the IVA is not shown on our credit report, does this lend any weight to the IVA and its contents now being "Statute Barred"?

    Furthermore i think we are now paying again on some of the creditors that were included in the IVA, is this legal?

    Any thoughts would be very much appreciated
  • I thought it was entirely up to the creditor whether or not they put any information on a credit report.
