Help, I don't know what to do

I'm not very familiar with this, so please excuse me if this goes on a bit.


About five years ago, I took out a loan and a credit card from Nationwide due to my dad leaving my mum, leaving us in a tremendous amount of debt which resulted in us having to sell the house to pay it off. The reason I took out the loan and the credit card was to pay for a rental deposit on a new house, and also purchase a car due to my mums being repossessed.

I had to quit college to work full time to support the family and help with the rent and also being to pay off what I owed Nationwide.

However, I was only able to repay the minimum amounts and eventually I was unable to pay it back.

In 2007 I went to the CAB for advice where they acted on my behalf to try and come to a resolution on my repaying the debt. They were not sympathetic at all, and they then sold my debts to a collection agency.

After months and months of negotiations, and my debts being passed around to various agencies, and writing the same letters over and over, the collection agencies currently dealing with me will not agree to a monthly repayment plan. Every month I have tried to pay £10 off each one, and they have now sent me a letter to say they will send bailiffs.

I'm really scared now, as I have done all I can. I don't know what else to do. I don't know what the best solution is, I just want it all to end.

Can anyone offer me advice on what I can do, I hate it because I didn't get into debt for my own personal gain.

    Hi Jedi,

    Easier said than done, but try not to worry, you've come to the right place. Can you post your statement of affairs, which people on here shorten to 'SOA' so that we can see exactly what you owe and to who and we can help you work out a plan. There's a link to a template somewhere which I can't seem to place, but someone will come along shortly with it, I'm sure.

    With regards to the debt collectors, there are lots of experts on here who know how to deal with these people, so you will get lots of advice.

    Hi Jedi,

    They CANT send the bailliff unless ( until ) you have had a County Court Judgement against you for a debt and THEN YOU DEFAULT ON THE ORDERED AMOUNT.

    If a debt goes to Court, because you have been trying to pay they will probably make an Order to pay monthly and this would be set at an amount that you should be able to afford.
    This is why the DCA will probably try to avoid Court.
    They wont try to BR you because ( by the sound of it ) you have no sizeable assets to take and it would cost them an arm and a leg to do so!

    IF a Bailliff calls..unless they have a COURT ORDER....they have NO RIGHTS. Just DONT LET THEM IN....not even a toe.

    Contact NationaldebtLine, CAB etc.........relax a bit, there are more people, including the Courts, on your side than the ****ing scum DCAs

    As Lovella says it would help if you post a financial statement of affairs (like a budget) using this link - http://www.makesenseofcards.com/soacalc.html. Choose format for MSE at the bottom and post on here. Then we will be able to give you tailored advice.

    If you get threats about baliffs read up on your rights if a baliff turns up and what to do/not to do on baliffadviceonline website.

    The debts are with two different collection agencies, one is with Wescot which is for £653.36 (The credit card I had) and the other is with CCS Collect, the loan which is for £2648.55.

    I've had a letter from each saying they are sending bailiffs over, and I've not had a CCJ as far as I'm aware? I really have been trying to pay!

    They will NOT be sending the bailliffs, not without a Court Order. They may send a Collector.......with less rights to enter your property than the milkman!
    Keep sending them the payments that you CAN afford, this strengthens your case should it go to Court.

    .....and if they send a Bailiff, make sure they dont add a charge!
    Take a look at www.oft.gov for the Guidelines on Debt Collection, that way you can see what is required of these scum and see that you can complain about THEM

    You can check your Credit File for free ( Experian e.g), or with a cheap charge if you cant use a CC online.
    That way you can see your current status and what may have happened without your knowledge.

    As said above, if you end up in court the Judge can see you have been paying what you can afford on a regular basis (I hope and by traceable means e.g. bank transfer). They won't order you to pay an amount you cannot meet.

    I live with my mum, but we go halves on most things as we have low incomes. She isn't able to support me through education. I went back to education last year, so my income won't always be as high as it is at the moment, because I won't be able to work as much.

    Car insurance is v.high! Have you had a claim? Or other reason to load?

    If you have an average car you should be able to only pay around £30 a month.
