Really sorry to hear about your problems but we are all here to help! :grouphug:

Firstly can you list the debts and who's name they are in (very importnant)? Also include APR's, limits that sort of thing.

Also, if you know what is happening regarding where you will be living, rent, mortgage anything like that, we will be able to help you with that aswell.

There's no pressure though. If you don't want to post something then don't. We will help you with whatever you want. :)

Have a look at this thread for an idea of an SOA if you need it.

    SS :D
  • to learn that you and hubby are separating.

I guess that when you have posted your SOA here and then we'll be in a better position to help.

The thing that strikes me though is whose name is the debt in?

    ... and a good lawyer.

I don't know whose name the debts are in but if there are any marital assets and so on, the chances are that either your husband will be left paying the debts if in his name or alternatively he'll end up giving you cash upon divorce which can then be used to pay off debt.

I wouldn't want to go into specifics but unless your husband is on low wages and has no assets, the chances are that there will be some financial settlement in your favour.

    Hi
Sorry to hear you are splitting with OH.
I would start by posting you SOA's on here - details all of you incomings and outgoing's (food/bills/etc), then list all the debts/apr's/balances/credit limits.

This may change if your OH decides they are not all yours, but i would go with the worst case scenario for now.

I would also go to CAB, and get advice on if he can leave lla debts to you. Are they all in your name?

Most importantly, don't worry, lots of helpful non-judgemental (mental :rotfl:) people will be along soon to help.

Sorry to hear you are parting, again the debts go to the person who holds the accounts usually, although i would say being married is another issue so a good lawyer is also a major factor.

I've just had nearly 18 months with the cccs who negotiated with my creditors, worked out what we could live on comfortably and issue the creditors with the free funds we could afford to pay them.

We recently found our property had nearly doubled its value in 3 years and took out a home loan to clear the debt. We are now in a position to sell the house in June pay off the m'gage and loan and still be in pocket.

I have to say that going to the CCCS will affect your credit rating though, which is why i reluctantly went for the loan to get my score going up again in order to get a mortgage for a new property further down the line.

I hope you can settle your debts easy enough, if its any concilation we owed far more than that but the moment it was sorted out the weight was lifted...

It's not patronising! Just madness! Don't you dare take on that debt because he isn't "up to it"! If needs be split it equally! It's his problem as much as yours! ;)

And the reason we answer so quickly is coz this place is bloody addictive! Plus we haven't got lives! :p :rotfl:

Oh ****! But I have got work in the morning! :rotfl:

Well if anything it's about time he took some responsibility! It's easy to get caught out if you both aren't singing from the same hymn sheet.

Don't you dare back down or concede all the debt or you'll have us to answer to missy! :p;)

    Hi and welcome

Sorry to hear of your parting with OH.

Stick to your guns and don't let emotional stuff push the debt all your way (I'm a fine one to talk about heart vs. head, but that's another thread :rotfl: )

Pop your SOA up when you get chance and the experienced ones will help you in no time.

    Good luck
