i feel i was given wrong advise from CCCS aswell, they tried getting me to do a DMP im on benefits and my money covers the priorities which is what its meant to do and i have no assets. the adviser i spoke to worked out that i had money spare(dont know how) and because of this he was trying to push DMP and said that i would have to enquire whever i could go br as according to the figures he worked out i could pay my debts in just over 5yrs and the courts may not allow it if my debts could be cleared in such a short time as it was only 7k. i tried explaining that what he worked out was wrong we must have missed something out. it wasnt till i asked on here about if he was right that i found out he was wrong. so im going to the CAB thursday for some deffinat debt advice as he wouldnt really talk about br as he had advised a DMP.
but this site has really helped me and is a god send
and can i just say that moorcroft has been the only DCA that has been nice to me my debt was only £140 with them but they was really nice when i was only paying them around £10 a wk. so i may have just had the nice ones answering the phoneIf you want to see the rainbow ,you gotta put up with some rain0 -

I fowarded paperwork to Moorcroft today by Recorded Delivery.
I also recieved a e-mail from the supervisory department at CCCSVA, in which they said they had contacted Moorcroft today and Moorcroft confirmed they had no notification of my IVA even though CCCSVA faxed through copies of chairmans report etc in October and again this month.....aptly they only applied the information CCCSVA faxed to them to one account...even though the three account numbers were stated on fax, they are faxing through details again tomorrow and have told Moorcroft they must cease contacting me immediately.....[ we'll see ! ].....and if this isn't resolved they will get a Manager from supervisory department onto Moorcroft .0 -

Ski all I can say is for me you have been mis sold this IVA. With illness how on earth are you to know if you will complete the 5 years. I
If you dont you could end up like I have, paid out over £5k in 16 months to Payplan, who once I was taken ill put the IVA on hold, and they carried on putting it on hold for over 18 months, hoping I would suddenly recover, when this did not happen they failed the IVA which was June this year, and took til September to put in writing to me.
My creditors got just £1300 of all that I had paid in and I was pretty annoyed when I realised I had wasted money bothering to do what I thought was the right thing in 2005.
Now I have had to go bankrupt which was what I should have done in 2005.
At least now I have nothing to FAIL.
Also the living allowances in BR are much more flexible than they are in IVA or DMP.
I wish you luck Ski but I would look closely at was this right for you.
The problem is when you approach these people, you are at a low ebb, worried sick, some are even suicidal, depressed, desperate.
And some of these companies know that, and when they say they can stop the phone calls, the threats of court and baliffs,it all sounds too good to be true. And they do stop all that, but if you try to reduce your payments at anytime the answer is normally NO, with things going up and wages not going up by the same amounts, people find themselves very very tight for money.
If you step back and see what they actually charge (mine came out of what was paid in monthly, no up front fees) they are a money making business, and some are not impartial enough and do not readily or fully explain other options to you.
Take care and I hope things work out for you. Mine is only my experience and I cannot guide anyone in what to do, but I can say that having been there, done that and got the T shirt, I have never now regretted what has happened, as Bankruptcy means I am now DEBT FREE. I was never that while in the IVA and that for me is the bottom line in all of this.

Sorry things did not work out for you with IVA.
My fees are also included in payments...paying £196 a month to CCCSVA for IVA.
It is true what you say, I was desperate and fed up with creditors on phone all the time and thought this was the best option.....now I doubt it is!
But I do not know how to get out of it......if I stopped payments when only having made one so far surely if I petitioned for BR a judge would throw it out saying I hadn't given the IVA long enough???0 -
Just recieved another email from CCCSVA supervisory dept., saying they have spoken to Moorcroft today and they have confirmed the other two accounts have now been put on hold and that Moorcroft would be writing to me to confirm this, they also confirmed recieveing fax with copy of chairmans report, and if I recieved any other contact from them other than this to contact supervisory dept., so they can take appropriate action.
Do you think that'll be it from Moorcroft now?....why do I think not!!0
