Hi skibadee, we were recently in touch with the CCCS and they recommended an IVA or a DMP to us, at the time we thought that it was ill advised too.
Our circumstances are similar, no assets, or job to protect, my wife will probably have to give up work within the next 2 years due to an child care issues, so therefore we wouldn't be able to complete the 5 year term that an IVA lasts.
I felt we were not listened to when we told the CCCS all this, but they still tried to push us hard for us to enter into an IVA with them.
We got some different advice from the CAB and Welfare rights, who both said without a shadow of a doubt that we should be going BR, which we are just about to file for.
All i'm saying is that we didn't feel that the CCCS gave us the best advice and perhaps you should get a second and third opinion on your situation, as it certainly helped us and lifted a weight off our shoulders.
Maybe you will get an IPA due to your surplus, but thats only 3 years, and we feel that is a small price to pay for a good piece of mind.

Just to add, even if you are given an IPA initially, as soon as your circumstances change this will be altered accordingly.Accept your past without regret, handle your present with confidence and face your future without fear0

Hi skibadee - I hope you don't think I was criticising you for taking CCCS's advice. I think people do panic when they've got creditors hounding them day and night and they look to organisations like that to have their best interests at heart and will do anything that might get them off their backs. Thats why this forum is such a Godsend!fiveyearplan.......yes it would be a good idea to mention this on IVA board too.
I took the IVA option as I was advised that was the best route for me...even though I explained about my health, and the fact that £300 of monthly income was from non-dependent still living at home.
I know I am going to end up down the BR route.....just wish I hadn't panicked because creditors were constantly on my case ..even though I was in a DMP originally.....and thought IVA sounded like the best option as it would stop creditors harrassing me and I would be making at least some contribution to my debts.....hind-sight is a wonderful thing!

Exactly fyp. Before I found this forum I panicked and contacted every fee charging company advertised in the press and on TV as I thought it was a way out from the constant hounding and threats I received. They all recommended the IVA route to me - strangely enough!Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free

Have written a letter to Moorcroft and photocopied Chairmans report and list of creditors included in IVA, I will be sending this to them by Recorded Delivery tomorrow.
Have also told them I am making an official complaint against them regarding the fact that they sent a doorstep collector even though I have repeatedly told them about the IVA, offered them the phone number for supervisory department etc., also they had told me last week that accounts were being put back on hold for another 2 weeks.
Will be contacting CCCSVA too as not happy with their lack of support.0 -
Moorcroft may or may not listen, but they are pathetic, i have disposed of them 3 times now, without the legal protection an IVA offers you.
Please dont dwell on it any longer or let it trouble you, even if you feel you where wrong entering the IVA in the first place, as it is in place, you are legaly protected from scum like moorcroft;)Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….

I know it seems a simple answer and i will probably be corrected but why don't you get some different advice, say the CAB and see if they recommend BR, if they do then just default on your IVA for a couple of months, this will give you enough money to go BR.
I don't have that much experience of IVA's but i know that alot of people have thrown alot of money into an IVA then had to go BR anyway, and wished they had gone BR to start with.
The most recent member i can think of is a Rylynn, perhaps her previous posts may help you.
Good luck & i hope you get somewhere with your complaint against those leeches at Moorcroft, i'm sure you must be protected through your IVA against this sort of harrasment.0
