I have a feeling that your wife didn't speak to a specialist money advisor.
She won't get blacklisted because you went bankrupt it is an individual thing. So she can carry on trading.
Don't sign the car over to her as you will get into trouble for getting rid of an assett.
Have you phoned National Debtline yet?

Thanks Deedee. Just got off the phone to the National Debtline and they were very helpful although said they couldn't advise course of action as it was up to me. They are going to put a lot of information in the post to me though and they gave me a lot of numbers to ring re various places to try and get some money (no more credit though !) I thought that about the car as well so I'll have to try and explain it to her later (she's on another late shift today so ships that pass at the moment as I was out at my interview this morning).
Only joint debt is the mortgage ...0 -

If the mortgage is in joint names the WHOLE debt will fall to your wife is she aware of that did the CAB point that out to her.
I am sure I am not wrong on that count but somewhere here will whip my backside and put you right if I am.
Whatever you do do not sign the car over, it would be seen in a very bad light prior to BR and they could take it back from her anyway. You could sell it to here but for the REAL value of it, this money could be used for BR fees and for you to find another place to live if that is what the outcome ends up as and I do not then think the OR would come down on you like a ton of bricks.
What is the car worth, however remember if you get a night job you are going to need a car I imagine, and unless this car is worth a lot of money I think most say over £2000 you may be able to keep it after BR anyway.

I do like the others feel something is not right here with the information your wife was given, or told you she was given, is it possible she has told the friend to lie to you? I don't think they did but luckily I think we still have some equity so we have to either keep the house if I get a job which can help towards it and hope the price drops enough to make buying the BI possible or sell it quick while there's still equity in it

If i got it , the jobs only a 10 minute walk away so not an issue really. I don't think the cars worth that much (8 year old Audi A4 with about 80,000 miles so should be in the £2-£3k area)

We did have 2 up until a couple of days ago - I had to sell mine to pay this months mortgage, council tax etc. She uses the one that's left for work (she's a community nurse so it's essential she has one as she has to travel to patients houses)

if you try to work out joint income and joint going out including all debt and post it people will be able to advise more ,
also state any benefits recieved how many people in house hold and any pets and cars as this would all come in to account if you were to go bankrupt,
all the people here are great and will point you in the right direction;)

Hi. Both cars were in my name but we kept the one she uses all the time. I've been trying to sell it for over a month privately at less than the Parkers price but around what similar cars were being advertised for, dropped the price twice and didn't get one phone call - ended up taking it to 3 dealers who all quoted me around the same price which was nowhere near the Parkers price (it was quite a big car and the bottom has fallen out of that particular market unfortunately). Similar cars also being sold on e-bay for about the same as I got so I've got proof of the real market price - if they use Parkers as a guide though I could be in deep doodoo cos in the real world nothing is getting anywhere near that ..0 -
I think in the present climate if you can shove proof under their noses they will not make a big deal of it. If you wife needs it for work then she does, but if you move out then she cannot have it? does she know that, as seriously the OR would take it back off her, it is not her asset it is yours and she is not going BR you are.
Even if you have equity, what if the house does not sell, you wont be paying for it she will can she afford to do that?
So I take it she has no idea yet that she will not have use of this car if she chucks you out? Not even sure she will have use of it if she does not but there would be a case for her working will bring more money in. So we need an SOA including her wages and any debts she may have or expenses, or what she contributes each month ie 50 per cent, 30 per cent.
Sorry know this is a pain when we ask so many questions of you but better you are armed with all the information than only half of it.
