Red Debt Collection - CCJ's

Hi,
Can anyone please advise?
The above debt was with capital one and was referred to lowells collections, I ignored their letters for a long while (which I know wasn't the best idea but in the meanwhile I was clearing other debts). I recently contacted Lowell and the debt has now been referred over to Red Debt Collections.

I have since written to Red making an offer of a payment plan with a lower settlement, but they appear to be completely ignoring my letters.

They have now sent me a letter which totally ignores my correspondence with them, saying that unless payment in full is received in the next 10 days (already 3 days in) any further correspondence will then be in the form of a court with legal action commenced against me.

I am reluctant to contact them by phone about this as I would prefer to keep a paper trail, but if they do commence legal action do I get the opportunity to appeal against the CCJ, or is it decided without my opportunity to appeal?

  • I may be wrong but i think lowells and red are one and the same.
  • Thanks, I did wonder that as their addresses are very similar. If that is the case it means that they have 3 of my previous attempts to correspond with them rather than 2.

  • Debt was defaulted in 2006. I've not asked for a CCA once a debt has been defaulted. Wouldn't I do that once the repayment plan had been agreed?

    No, you need to do the CCA request now. It places the debt in dispute and you may not have to repay it if they fail to produce the CCA.
