  • Oh well, poo is hitting the fan!!! Recieved a letter today from the county courts for the HSBC order.....they want total payment before 3rd November or the baliffs are coming!!! What do I do??

    I thought there was a court order already in place for this?
    Do you have a CCJ?
    Have you kept the payments up to date?
    What was the HSBC debt for - did you request a copy of the cca?

    Might be worth starting a new thread to deal with what your options for this particular debt may be and what you should do to deal with it. Have you requested that the case be heard at a court near you?

    There already is a CCJ on the HSBC debt and the Egg debt but I haven't paid anything at all to anybdy for 2/3 months. They want to send baliffs round....I'll call the company today. I was paying them £4.00 per month and nowthe pro-rata payments are £13 per month but Egg have gone down from £85 to £60, do you think thats right?

    I rang HSBC and they said bascially its too late and to contact the baliffs, so the court is sending me out a N245 that I'll have to fill in etc before Monday!!!

    Really don't know what to do now. I though I was getting things sorted and now its all gone haywire again!!

  • Why is is that the 'bigger debts' are quite happy to understand the fact that I've not mentally been able to deal with all these since July etc, and are quite willing to for me to re-set up the standing orders but the smaller £1pcm debts are kicking off something stupid about 2 months worth of arrears and threaten court for debts under £500??!?!?! !!!!!!!!!

  • Right am getting really stressed now!! All muy money comes in weekly yet all my bills go out monthly and I'm trying to work it so that they don't al come out at once, but my head is soooooo mashed I really don't know what I'm doing!!!!!!! HELP#!!

    I don't think I can be much help sorry but would it help to list all the dates(in date order) and amounts of bills AND debts that go out all month on here and also post your incoming money with weekly/monthly dates of that too? Then it might look clearer plus someone may be able to advise you?

    I have 3 bank accounts with the same bank.

    Current Account: Wages get paid into this account then X amount is transferred automatically to Bill Account to cover all bills for the month. Any money left in this account is 'spare' money.

    Bill Account: No cashcard for this account. The monthly amount paid into this account is just left there ready for all the household bills to roll out of all month. I do have the transfer set a little higher than is needed so that if there are any unexpected bills then I can use the 'extra' money in here to cover it.

    Savings Account; If there is any spare to save then I transfer into here via internet banking.

    Works for me coz I know that as soon as wages are paid in the bill money is instantly trasnferred so I never have to work out my money coz what ever is in the Current Account is 'ours' for the month as no direct debits or standing orders go from that account.

    I appreciate having a situation likes yours probably doesn't make it easy to have a 'simple' system as I have but I am sure you can find a way to simplify how your money is worked out. So good luck with it.

    Am just getting so stressed!! Kids are running around like banshess...am gonna forget it for the rest of today and sort it out tomorrow. I'm thinking I may call CTC and see if they can pay fortnightly instead of weekly, then I can have the smaller amounts going out one week and the biggers when CTC comes in??? Just stressed......

    Whatever the CCJ determined the payments should be is what you should pay to HSBC and Egg. If HSBC say they are willing to accept a different amount, you should get this in writing confiming that they are aware of the amount the CCJ had set and are prepared to accept a lesser amount. If they hastle you to increase the amount you are paying, they should go to court for a redetermination of the amount the court agred. These 2 debts are your priority ones over the other unsecured debts. Try to make arrangements to pay the missed payments as soon as possible.

    If you have been making payments of more than the amount the court had agreed to HSBC, i'd mention that on the form

    eg you have made 25 payments so far and the court said you were to pay £4 per month towards the debt. 25*4 = 100 total so far. If you have paid more than that, inform them of this.

    I would strongly recommend starting a new thread to ask about filling in the N245 form. Explain what has happened with the payments made to HSBC and what the court had said you should have been paying. Others may be able to suggest what you can put on the form as HSBC are not willing to discuss you making repayments for the missed payments. Also mention if HSBC were harrassing you or contacting you to increase the amount of your payments after the CCJ was awarded incase that is important.

    I think that KM is right in having some kind of structure to your payments to make it easier for you. Do the payments need to go out on a certain date or can you pay as long as they have payment by the end of the month. It should be less hastle if you have a way to plan this out so you know what needs paying and when.

    Re the HSBC Court order, they haven't been trying to make me pay anymore, its the fact that I've missed 3 payments. And the only reason I have is that my heads been up my backside with all my personal circs etc. I called HSBC to offer the 3*£4, but they said its too late as its with the baliffs. Just waiting for the N245 to come today. I'll just have to hope that the judge or whatever understand how messed up people can be after marriage breakdowns.

    Egg are being fine about the fact that I missed 3 payments, I did call everybody and explain the situationand when I spoke to Egg(the company working for) they were fine and just let me reset up my S/O.

    I've applied for a new account so I can have two....one for bills etc and one for spends. Not that either will have much in, until then I'll just have to be very careful with wha I'm spending until I figure out what comes in and goes out when.
