Advice Needed CCJ'S

Just after a bit of advice guys please.

I've been issued two CCJs 1 for £80 per month with DG Solicitors and 1 for £26.00 per month with Howard Cohen.

I've missed 2 payments on each, which I realise was a stupid of me i should have set up standing orders the moment i got them.

I've been on the phone to them this week trying to sort out; I have informed DG Sols that I can make the full payment plus an extra £20 per month toward arrears by standing order which I have set up. They have said that I can do that but can't guarantee that their Client won't want to take the matter further.

I have tried to do the same with Howard Cohen but they won't entertain setting up a standing order until the arrears are clear which could do if they would let me set up a standing order for while I'm away as I have funds going into my account then.

I am going away on holiday on Monday for 3 weeks so obviously can't monitor the situation. I don't want the Baliffs just turning up at my house as I won't be there, also I have to leave my car on the drive are baliffs allowed to just take something (i.e. my car) if I'm not there?

At the moment I haven't been issued with a warrant of execution but have received two "Notice of Transfer of Proceedings"
Remember ....its not a bargain unless you need it :D

    You haven't been settling your CCJ debts but you can afford to go on holiday for 3 weeks and run a car? Priorities........:confused:

    I don't know anything about CCJ's cos although I'm in debt I keep on top of it because it all scares me:o

    Maybe that's a good thing as I manage to still have a good credit rating(good) whilst in debt(bad):o Should of listened to my mum:huh:

    So although I simathize I agree, you have to pritoritize (cr*p at spelling)

    Hi Dixie - they usually transfer cases out to your local court when they want to start enforcement proceedings that have to be issued out of a local court such as charging orders or attachment of earnings. They can issue warrants direct from Northampton which is what makes me think they are going to try a different method.

    They cant issue enforcement proceedings if you are up to date with your payments so if you can catch up that would help. x x

    Hi hun are you sure these are CCJs. Do you have paperwork from the court to say you have CCJs. I am asking as the 2 companies you are talking about are DCAs. Does the paperwork have court stamp on them, How did the CCJs come about. Who was the original creditor in each case. And who set the payment level you are on now. Is this what you offered the court or the DCAs. Can you post as much info as possible about these debts please hun. How much and who to. Would be a great help if you could. You are more than welcome to PM me the info if you wish. x x x x

    To be on the safe side i would move your car out of the way until we know exactly what is going on. Who issued the transfer of proceedings. Have you checked your credit files recently. x x x

    Thanks for your v.useful input. FYI holiday paid for by someone else. Car essential for work, no car, no work, no money to pay creditors.

    Thanks that help a lot. I can pay the Howard Cohen one as its only £52.00 but not until next Friday when I'm away. I think i'll take the paperwork with me a pay using my card over the phone that way I know they've got the payment straight away.

    The DG one have just set up Standing Order with the bank and will fax them and let them know as they are shut at the weekend. I should be able to settle the arrears when i get back in three weeks but at lease they'll also have been receiving payments in the meantime.

    Any idea how long it takes to enforce these things?

    Here's another suggestion: whoever pays for the holiday, that's still 3 weeks you could be out earning extra money to clear your debts - and maybe you could even have said to your kind benefactor, "thanks for the offer of a holiday, but what would really help would be an equivalent donation in lieu as I am up to my eyes in debt" and it keeps me awake at night worrying about it all.

    Howard Cohen are pretty toothless in my experience, full of threats. I wrote to them with an offer, which they declined but I've continued to pay what I offered for the last 6 months.
