Help needed regarding statute barred debts

Hi, I need some advice.

I have several credit card debts from years ago, some of which I am being chased for and I will admit I have largely ignored in a "head in the sand" manner.

The problem is I am not sure if some of them would be statute barred or not? I have lived in Scotland for 6 years and I am sure most of my debts have not been paid/acknowledged since 2006. However I did live in England when I first got the credit cards. Does this make a difference to the statute barred rules?

My other problem is I am not sure WHICH ones I have paid/acknowledged recently. I definitely started paying money to one DCA foolishly without even checking that this debt definitely still existed/they actually owned it. As soon as I realised I shouldn't have done this I stopped payments but that was definitely within the last two years or so.

I also know that two of the debts have been paid of (the 1st through my bank and the other about 5 years ago when I took a "deal" and paid them half the amount owed).

I just cannot remember exactly how many/which ones are outstanding and which of them I have paid/acknowledged in the last 5-6 years. I know that a few years ago I sent an email to one of the DCAs after they scared me with a collection notice letter but I never received a response and they never came to my door! Would this count as written acknowledgement?

However a DCA has come to my door recently from a company called Scotcall (I wasn't in but they left a card) and I don't even know which debt they are supposedly chasing because I don't appear to have any letters from them. I don't want to call them to find out but I am scared they will come back when I am in!!

Also, I am now being chased for a debt which I know is not mine because the DCA claims it's for a gas company and I have never had my own house/a gas contract. However, the address listed is one I lived at for a couple of months in 2006 and I suspect a family member got the account in my name and I don't remember signing anything. However, there is no way I am going to tell them that and get this family member in trouble so I don't know what to do! They cannot pay it and neither can I. Should I just send them a "I do not acknowledge this debt" letter?

And what is the best way to go about checking if my debts are statue barred? I am worried that asking for a credit report will open the floodgates for DCAs to start chasing me for all my debts at once. Is this something that really happens or is it a myth?

Also, do statute barred debts automatically come off your credit report? Meaning anything still on there definitely isn't statute barred? I have no idea how it works to be honest.

I just don't know what to do! I can't even afford to pay these debts at the moment because I am unemployed so if I can prove some of them are statute barred/not mine that would be a weight off my shoulders.

  • I've had a look through some of my old paperwork and have now found that another one of the debts I'm being chased for I don't think is mine due to the date it was allegedly taken out.

    However, this is one that I have made payments towards foolishly without checking what the debt was allegedly for first. I just got scared by the DCAs bullying letters and because I knew I did have some debts I assumed it was one of those and paid about £600 off it before I realised my mistake and stopped payments.

    Doesn't anybody know if I can dispute this debt now and ask them for proof or does the fact that I've made payments (about 3 years ago) mean I can't now dispute it? Also, f they can't prove it's mine can I get that money back?

    Please help!
