cheque centre

Hi there just a question incase anyone has any experience of this but my partner has a loan with cheque centre and he has stopped them clearing his account every month via the letters on here which were v helpful. now they texted him this week and said they would accept a payment of £390.00 to clear the loan , he rang and set up a direct debit to pay off £100.00 monthly and was told if he got this text it would be honoured.

then he got another text saying his debt was going out for collection

when he phoned back they had no record of him setting up the DD or of the text offering him to pay back £390.00 to clear the debt

any advice on how to proceed with this???

    As I said on your other post, phone calls aren't worth the paper they're written on - and also in their eyes anyone could have sent the text.

    He needs to go into a branch or send them a recorded delivery letter outlining payment arrangements and asking for confirmation in writing.

    If it isn't in writing, it didn't happen.

    A Settlement agreement must be in writing with the golden statement "In Full and Final Settlement". If those words aren't in writing, they simply suckered you into repaying your debt.

    You could complain of course, there may be a slight glimmer but I wouldn't hang my hat on the chances of success.

    They will of course argue that whilst you were claiming that you could not afford to repay anything, you all of a sudden found £100 to give them, which is difficult for you to defend..
  • He lost his job which he told them about, and then offered£100 a month when he was employed again so its pretty explainable
