CCA request refused? after 5 weeks

Hi i am posting this for my husband we have been trying to sort out our credit files and he has a default in 2009 from Bt it says the contract started in 2007, we sent a letter to Bt and enclosed the £1 for a CCA request on the 08/03 we have received a letter today dated 16/04 5 weeks later saying
Your letter regarding a default notice and CCA has been received by this office, i apologies if you were misinformed but requests of this nature should be dealt with via Equifax, Bt will then investigate and either remove the credit fie entry if it should not be there or uphold and provide a reason as to why the default has been registered. this is usully done within 21 days of the customer raising the query with Equifax,
i am sorry i have been unable to assist you and return your postal order,
Now we are very confused, BT have taken 5 weeks to respond to my CCA request and are now telling me this.
we have opened a dispute through Equifax but don't hold out much hope can some one advice on what we can do please or any letter we can send back to them?

A phone bill would not come under the Consumer Credit Act.
You obviously feel that no money was ever owed.
A Subject Access Request under the Data Protection Act may be the way to uncover the history of the acccount but to avoid the £10 fee why not try first a letter just saying:
"Please send us a complete statement of account for the period xxxx to xxxx showing all transactions, and demonstating how the alleged debt of £Y came into being."0 -
I will send them another letter today do i need to send a payment to them for this information, also we are not trying to get away from not paying, if we do owe we will pay it, but just find it strange how we have never had any default notice from them, or any letters saying we owe them anything0

Just an update BT have removed the default from the credit file0
