E: 28/04 Win £30,000 (small effort)

1. By entering a Competition you shall be deemed to have agreed to these General terms and conditions, and to the specific terms and conditions applicable to each Competition.
2. In these Terms and Conditions, "we", "us", or "our" refer to BNY Mellon Asset Management International Limited (the "Promoter").
3. The Competitions are open to all individuals who are aged 18 or over as of 23 January 2013 and who are either (i) UK residents, (ii) Germany residents, or (ii) BNY Mellon Entrants (as defined below) who reside in California, New Jersey, New York, or Pennsylvania only. No purchase is necessary to enter the Competitions.
4. Each entry to each Competition must be submitted with a valid email address for the entrant. Employees of the Promoter and its affiliated companies ("BNY Mellon Entrants") must use their BNY Mellon email address for the purpose of entering the Competitions. Entrants must be the authorised account holder of the email address submitted at the time of entry. "Authorised account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address. We accept no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach us by the relevant closing date for any reason. Proof of sending is not proof of receipt. Entries sent via agents or third parties are invalid. You are responsible for the cost (if any) of sending your entry to us.
5. Prize draw winners will be selected at random (by an automated computer process) from qualifying and valid entries under the supervision of AML Communications Ltd. Odds of winning any prize in a prize draw Competition depend upon the number of eligible entries received.
6. Competitions that are judged according to skill (the "Rowing" Video Competition and the Photo Competition) will be judged by an independent panel of judges assembled by the organiser of The Boat Race, The Boat Race Company Limited. In the event that there are no entries for a Competition that meet all of the judging criteria, we retain the right to decline to choose a winner for that Competition.
7. In the event that you submit a video or photo to the "Rowing Video" Competition or the "Photo Competition":
   1. You warrant that you own the copyright to your Competition entry as its author. If another person has photographed or filmed your entry, you warrant that you have received an assignment of all associated copyright to that entry from that person. We may ask to see evidence of that assignment at any time;
   2. Your entry must not be copied, must not contain any third-party materials and/or content that you do not have permission to use, must not promote any goods or services other than those of the Promoter or include any trade marks (other than those belonging to the Promoter), and must not show inappropriate or dangerous behaviour, or otherwise be obscene, defamatory, distasteful, offensive, or in breach of any applicable law or regulation, or in breach of any confidentiality obligations owed by you to third parties.
   3. You confirm that each individual whose image is featured in the Competition entry has given consent for the use of his/her image in connection with this Competition and in accordance with these Terms and Conditions. Where an individual whose image is featured in a Competition entry is aged less than the age of majority in the jurisdiction in which they reside the entrant confirms that the parent or guardian of that individual has given the relevant consent.
8. By submitting an entry to the Competition, you give the Promoter permission for your entry to be published on the Promoter's websites (including but not limited to https://www.whichblueareyou.com) and on any social media account controlled by the Promoter, including but not limited to Facebook and Twitter accounts ("Promoter's Social Media Accounts"), and you grant the Promoter and its affiliates a non-exclusive, royalty-free, worldwide licence to use and publish your Competition entry in electronic format (including on the Promoter's websites and the Promoter's Social Media Accounts) and hard copy (including in the Promoter's publications) for purposes connected with the Competition (including to identify your entry as a winning entry, if applicable), and to adapt the entry to enable such publication (including to crop or otherwise edit it for such purposes), and you hereby irrevocably waive, for the benefit of the Promoter, all moral rights in the entry to which you are entitled.
9. The prizes are non-exchangeable, non-transferable and not redeemable for cash or any other prize. We reserve the right to substitute the prize with an alternative prize of similar value in the event that the original prize offered is not available. The winner is responsible for any tax liability arising from winning the prize. We accept no responsibility for any costs associated with the prize that are not expressly included in the description of the prize.
10. We will notify each potential winner of each Competition of their potential win via email no later than 14 days after their selection as a winner. The potential winners must respond, provide any proof of identity and proof that they satisfy these Terms and Conditions reasonably requested by us, sign and return an affidavit of eligibility and liability release (if requested) and claim their prize within 14 days of us sending notification of their potential win. If the prize is unclaimed after this time, the required proof is not provided, the affidavit of eligibility and liability release (if requested) is not received, the prize is rejected or the selected entry is invalid or in breach of these Terms and Conditions, the prize will be forfeited by that entrant and we reserve the right to offer the unclaimed prize to a substitute winner selected in accordance with these Terms and Conditions (and this condition 11 will also apply to that substitute winner). Potential winning entrants have not won a prize until confirmed by the Promoter.
11. Subject to conditions 7 and 11, the names of the winners for each Competition will be available by emailing clientservices@bnymellon.com with ‘Which Blue Are You Competition' and the name of the specific Competition listed in 1 above for which you are requesting the names of the winners as the subject line from four weeks after the closing date of the relevant Competition.
12. Use of your personal information: We, and our agent AML Communications Ltd, will use any data submitted by entrants only for the purposes of running the Competitions, communicating the names of prize-winners and organising the post-event publicity and promotional activities outlined in condition 14 below. We shall use and take care of any personal information you supply to us as described in our privacy policy, a copy of which can be seen at https://www.whichblueareyou.com/privacy-policy, and in accordance with data protection legislation. By entering a Competition, you hereby consent to our collection, retention, use and distribution of your personal data for these purposes.
13. You agree to take part in reasonable post-event publicity and promotional activities relating to the Competitions and our "Which Blue are You" activities and to co-operate with us and AML Communications Ltd in that regard. In addition, you hereby consent to the use by us and our affiliates, both before and after the closing date of each Competition, for an unlimited time, of your name, photograph, voice and image in such publicity (in any medium, including still photographs and films, and on the internet, including any websites hosted by us and our affiliates) and in advertising, marketing or promotional material without additional compensation or prior notice.
14. We reserve the right to withdraw, amend or suspend any of the Competitions at any time and without notice if we deem it necessary to do so (acting reasonably), in particular, if for any reason the Competitions are not capable of proceeding as planned due to computer virus infection, unauthorized intervention, tampering, fraud, technical failure or any other cause beyond our control. In addition, we reserve the right, at our sole discretion, to disqualify any individual who has tampered with the entry or Competition process or who has deliberately damaged the "Which Blue Are You" web-hub (https://www.whichblueareyou.com) or undermined its legitimate operation.
15. We may disqualify your Competition entry if your entry does not comply with these Terms and Conditions, you have not obtained the consents detailed in condition 8 above, you are not eligible to enter the Competition, or you cannot be contacted. In the event of disqualification, we may select a new winner in accordance with the selection processes outlined in the Competition-specific terms and conditions.
16. In all matters relating to the Competitions, our decision and the judges' decisions shall be final and we will not respond to queries or enter into correspondence.
17. We accept no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering any Competition or accepting a prize. We further disclaim liability for any injury or damage to your or any other person's computer relating to or resulting from participation in or downloading any materials in connection with a Competition. We are not responsible for any typographical errors in the announcement of prizes or these Terms and Conditions, or any inaccurate or incorrect data contained on the websites or apps associated with the Competitions. Nothing in these Terms and Conditions shall exclude our liability under law for fraud or fraudulent misrepresentation, or for death or personal injury resulting from our negligence.
18. We shall not be liable for any failure to comply with our obligations relating to any Competition where the failure is caused by something outside our reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
19. You acknowledge that:
    1. this promotion and the Promoter's Facebook page are in no way sponsored, endorsed or administered by, or associated with, Facebook;
    2. any information you provide via the Promoter's Facebook page is provided to the Promoter and its affiliates rather than Facebook; and
    3. you hereby release Facebook from any claim or liability suffered in connection with the promotion.
    4. In these Terms and Conditions, all references to times and dates are to those in the UK time zone.
20. If any court or competent authority finds that any provision of these Terms and Conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these Terms and Conditions shall not be affected.
21. The Competitions and these Terms and Conditions will be governed by English law and entrants to the Competitions submit to the exclusive jurisdiction of the English courts.
22. The Promoter of these Competitions is: BNY Mellon Asset Management International Limited, BNY Mellon Centre, 160 Queen Victoria Street, London EC4V 4LA.

1. BNY Mellon Entrants are not eligible to win the £30,000 main prize in the £30,000 Prize Draw. They may participate but will be placed in a separate prize draw, with different prizes, as detailed in condition 28 below. As for all Competitions, BNY Mellon Entrants must use their BNY Mellon email address for the purpose of entering this Competition, in accordance with condition 5.
2. To enter the prize draw, you must complete at least one of: 1. the "Which blue are you" quiz; 2. the "Boat Race quiz"; or 3. "Vote for your blue", all three of which can be found at https://www.whichblueareyou.com/fun-stuff. Once you have completed one of these three quizzes, you must insert all required details into the online form (including your name and email address) and press submit. Completing any of the three quizzes, followed by completion and submission of the online form, will provide one entry to the £30,000 Prize Draw (or the alternative draw for BNY Mellon Entrants, as detailed in condition 28 below). Each quiz can only be completed once per person. A maximum of three entries to the prize draw can be made per person, by completing all three quizzes.
3. Entries must be received by us between 9am on the opening date of 14 February 2013 and 12 noon on the closing date of 28 April 2013. Entries received outside this time period will not be considered.
4. All non-BNY Mellon Entrant entries will be entered into the £30,000 Prize Draw which will take place on 28 April 2013. Only one £30,000 prize will be given away. The first entry drawn for the £30,000 Prize Draw will be the potential winner. The prize draw for BNY Mellon Entrants will take place on the same date. One £5,000 prize and 49 Hackett fleece jacket prizes will be given away to BNY Mellon Entrants. For the BYNM Entrant prize draw, the first entry drawn will be the potential £5,000 winner and the next forty nine entries selected in that draw will be the potential winners of a Hackett fleece, approximate retail value of £50.
5. The winners of any prize are responsible for any tax liability arising from receipt or use of the prize.
6. Only one prize may be won per person.
7. Subject to condition 11, the winner of the £30,000 or £5,000 main prizes will receive £30,000 or £5,000 as applicable (which, for a winner in Germany, shall be converted into Euros, and for a winner in the U.S. shall be converted into U.S. Dollars, each at the prevailing exchange rate used by the Promoter's bank, The Royal Bank of Scotland plc, at the time of payment and be paid net of any bank transfer fees) by bank transfer into a UK building society, UK bank, German bank, or U.S. bank personal account in the name of the winner by no later than 9 June 2013. Winners of a Hackett fleece will have a fleece despatched to them by recorded delivery post, courier or by hand by 9 June 2013, with size preferences being met subject to availability.

Then insert all the required details into the online form (including your name and email address) and press submit. All videos must be a minimum of ten seconds in duration. You can enter as many times as you wish.
2. One main prize will be awarded and consists of £1,500 worth of Hackett clothing vouchers. There are 13 weekly prizes consisting of a bottle of Bollinger champagne, approximate retail value £42. Entrants under the age of 21 as of the date of entry and who reside in the U.S. are not eligible to win the Bollinger champagne.
3. Entries must be received by us between 9am on the opening date of 25 February 2013 and 12 noon on the closing date of 25 May 2013. Entries received outside this time period will not be considered.
4. When choosing the winners, the judges will take into account the following factors: humour, originality, "wow" factor (for instance involving a large group of people or an unusual location) and connection with BNY Mellon.
5. On the Monday of each week during the term of the Competition (excluding the first Monday, 25 February 2013), the panel of judges will select a weekly prize potential winner from all entries received during the preceding Monday to Sunday period (inclusive). The final "weekly" potential winner will be selected from all entries received between Monday 20 May 2013 and Saturday 25 May 2013 inclusive. Only one weekly prize will be awarded per person, however winners of the weekly prize are eligible to win the main prize.
