Payday loan Has the time to complain run out?

Can anyone give me some advice please.

Have been sorting out repayments on eight payday loans since May 2012. The only one that wouldnt agree was WageDay Advance who I tried constantly with until July 2012 to agree a repayment plan.

In July 2012 they transferred the account to Motormile Finance
and escalated the amount due from £420.08 to £650.08.

For the next 8 months I was constantly harrassed by phone,email and letter by Motormile who refused to accept a repayment plan on the £420.08. I was in contact with them by email trying to do this until March 2013 when in desperation contacted Wage Day Advance again and asked them to agree the amount I owed as £420.88.

On April 2013 I received a final response from them basically saying there was nothing they were willing to do and the amount of £650.08 was still owed to Motormile.

Motormile continued to harass me and then finally they have now defaulted the amount of £650.08 onto my credit file.

Is there anywhere I can make a complaint to regarding this? Unfortunately I know that I should have made any complaint about Wage Day advance six months after they sent the final response but due to Motormile harassment and health problems I did not do this in time. Is there anything I can do? I have never had a problem at repaying the £420.08 on a plan and have stated this many times on emails to Wage Day Advance & Motormile.

Any help would be gratefully received !!

    And exactly how much have you paid off this loan between May 2012 and today, whilst all this has been going on?

    Motormile are the worst DCA doing the rounds at the moment, they are a bunch of sharks, they ignore the law, they make threats on the phone they would never put in writing, and they ignore letters, emails, etc the worst thing is in most cases the ombudsman sides with them, as they say they are entitled to chase you for the money owed, a DCA should not have applied any more charges to your account, I would refuse to pay them any more than was originally owed, I would request a breakdown of the amount they are claiming you owe, in writing, see what comes back, also block there number on your phone, insist you will only deal with them in writing, they may send round a doorstep agent, as this is there particular specialty, you do not have to deal with them at the door, if one turns up, just say you will deal with this matter in writing only, film the agent on your phone, they don't like that, remember they are not bayliffs and have no enforcement power whatsoever, so don't be stressed by them.

    I havent paid any of the amount to date as I was advised that if I did start paying money to them then it would appear that I have agreed to pay the full amount with all the charges. As previously stated I am not trying to avoid the original amount I owed but will not accept the extra charges and have arrangements in place to pay several other PDL companies with the original balance when I couldnt continue paying in 2012.

    Sourcrates thanks for your advice... I do have a letter ready for Motormile if they turn up at my house and I have advised them I will only communicate by email. I will now send them an email requesting a breakdown of the balance they are asking for.

    What date did they default the account on your credit file? It should have been July 2012, as transferring a debt to a DCA is a condition of default as per the ICO default guidelines. When was the payment due and missed?

    If later, write to motormile, headed formal complaint. send signed for or proof of posting and mention in the letter you have done so.

    State that no response within 8 weeks you will be referring to the FOS.

    This gives you grounds for a valid complaint and you can stick the original problem on there too. Quite often these kind of companies won't know you originally complained and had it rejected.
