Howard Cohen court papers

Options
This morning I received court claim papers from Howard Cohen for an old abbey national overdraft to the value of £1500.
I honestly can't even remember when this was from,I can't see it on my credit file I don't think either,unless I'm looking in the wrong place .
What do I do from here? Would really appreciate any advice please as I'm very worried. Thankyou

    Responding to the court papers would be a good first step.

    Acknowledging service online gives you more time to formulate a defence.

    A provit letter maybe helpful, check out legal beagles (received a court claim) for more info on your options :

    Do you know why no such debt would be showing on my credit file? I'm confused !

    Could be more than 6 years old, in which case a statute barred defence would be appropriate.

    Hi Mrs Lev,


    So there are 3 credit files to check (Experian, Equifax and Call Credit), this may be worth doing to see if you can find any information on this debt. However, it will only show for 6 years from the date of default so if it is older than that, I am afraid your credit files won't help.


    If the debt isn't on your credit file, it is possible that the debt is too old to be enforced at court under the limitations act. The limitations act states that if there has been a 6 year block of time, with no payment or written acknowledgement to the debt (from you) and no court action started the debt becomes statute barred and is too old to be chased at court. The 6 years starts from when the debt falls due, which can be tricky to determine with an overdraft, you normally have to work from when it was called in.


    You need to bear in mind that any payment or written acknowledgement would restart the 6 year clock and if the account was in joint names with someone else that can affect the limitations act as well.
