    So thats basicaly a yes. It does seem fair. I've never understood the his and mine attitude when you are married. I could be debt free within a couple of months if I didn't count the debt in his name.

    I agree with you - my OH are not married yet but we share everything - there is no mine or yours but the Trustee would only be interested in the OP share of any equity and this can be minimalised in many ways so that the home is protected and a minimum amount is paid to the Trustee for them to relinquish their Beneficial Interest

    The reason why I am dealing with my debts myself is that my husband and I have only been married for two years, all the debt was from before we were married, and I haven't paid a penny towards the mortgage. If we could afford to pay back the creditors with his wages, we would. We tried this for a year but were just sinking further into debt.

    Basically I am not well enough to work at the moment and cannot see me being able to any time in the near future. We can't afford to make repayments from my husbands salary as there would be nothing left. It seems to be from the information I have that I cannot apply to be made bankrupt until certain things happen like a charge for payement or statutory demand is served to me. It doesn't seem to be the case that they're going to do this without being able to get money from me as a result. I think it isn't as easy to declare yourself bankrupt in Scotland as it is in England.

    What you must remember is that the only requirement to bankruptcy is that you are insolvent. If you spend 1p more than you earn every week/month - you are insolvent. That may sound simplistic but that is the bottom line!:eek:

    I believe that there is a motion going through the Scottish Parliment to bring our BR more in line with England - I think I read somewhere that it was supposed to be through in 2007 - will see if I can find anything out.

    If you have only been paying your creditor's token payments I would have thought you would have received some Statutory demands from them
