Suspended then reinstated but could be suspended again

Hi

Sister is self employed was suspended by her company 12 years with them after aligation made.

Manager investigating went to see people making aligation only to be told third party /cab/ handling and to speak to them.

Sister now been reinstated pending CAB dealings and told may be suspended again once CAB get back in touch.

Is this legal surely if its a open investigation it should be that you can't mess people around like this.

    A self employed person can't be suspended by a company - they may suspend any contracts they have with the person but by definition they are not employed to be suspended by them.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    I would be very surprised if CAB undertake any investigation of this sort. The whole thing sounds like some sort of bizarre wind up - perhaps, as I saw posted on another thread, it's the kids getting bored early in the school holidays.

    I am not a pathetic troll. I chose to keep my initial post vague to keep anonomous for this involved. I chose not to add to original post due to asking for advice instead getting stupid comments regarding my initial post (scheming gypsie anyone)

    She is self employed just works continually for same firm. A financial transaction was made customer disputed this chose to get advice from cab who wrote to said company

    Company then suspended sister then un suspended asper previous reply.

    As per replies so far I expect no useful advice to be forth coming as such

    So she works for a dodgy company that decides to treat her as "self-employed" to avoid PAYE and paying employer's national insurance. I hope your sister is correctly registered as being self-employed and paying her NI.

    She should check her contract to see what it says they can do.

    This all sounds very strange. If she was employed by them then you would expect them to suspend her on full pay as a netural action until they can get to the bottom of what happened.
    She should be checking her work documents to find out what policities and procedures she should have used in the situation and whether she followed them. For example, should she have seen a purchase order, or get a customer to enter their pin, or got verification for a mail order transaction etc etc. Surely this company has a procedure for such a transaction?
    If she followed the procedure then it will come down to her word against the customers which could get tricky.
    Having said all that it will obviously be a bit different if she is self-employed although from what you have said it sounds like HMRC might well decide that actually she is a direct employee and the company are trying to get out of paying tax/ni.
    She needs to find out what the companys disciplinary procedures are in this situtation and whether they are following them, and basically what on earth is going on.
