Strangest grievance meeting ever!

I did go into the meeting with a plan but I was blind sighted because the meeting was nothing like my original grievance meeting.
I had prepared a list of questions that I planned to ask but many of them became irrelevant when it transpired that HR were just as clueless about the situation as I was.
At one point I had to ask if this was really happening.
I did get my head together and asked important questions at the end but I'm not sure how to proceed now.
I asked questions such as "why didn't anyone call during my sick leave to clarify why I felt unable to work if the environment had been adjusted", "why did you not provide the list of adjustments when I asked" and "given that you now know that I was undergoing bullying, harassment and adjustments were being with held making my job impossible, do I qualify for company sick pay", "will I be paid company sick pay retrospectively".
I didn't get many straight answers.
I was thinking of leaving it a week to see if they get back to me and then writing with a review of the meeting and reiterating that I would like company sick pay to be paid as compensation (is that the right word?) for what I was put through.
As a further complication I have developed a distrust of medical/social workers and other "helper" workers as a result of this and I've also lost confidence in aspects of my job. My new work are helping with the confidence issues but my GP has suggested counselling, would it be appropriate to request that my old company pays something towards getting this privately? The NHS list is extremely long but I'm not sure if this is appropriate.0 -

I thought a week would be reasonable as she said she would need to investigate and write out the result of the meeting to me. Is this nonsense too then?0

I dont know whether an ex employer will pay for counselling. I do know someone who was bullied very badly in a job and their employer paid for them to see a psychologist, she had been bullied over a long period of time and the bullying didnt stop after the counselling but they had to admit liability for the damage done, you could suggest it, but Im not sure you'd have much luck getting them to pay for it.
Re sick pay, were you getting SSP and nothing else? Again, Ive known companies who pay 6 months full pay and 6 months half pay when people are ill and companies who have one months full pay if you are off and that is it.
A lot will depend on your contract and the goodwill of the company.
Have you heard of the living life project, its for people suffering from anxiety and depression, its through NHS 24, the number is 0800 328 9655. I picked up a leaflet at an open day at my local football club and I did try and access the service as Ive a history of anxiety and work related stress, but they wouldnt take me on as it wasnt my first instance of anxiety or depression due to work related issues. But it might be useful to you. They offer CBT through face to face counselling and telephone sessions.0 -

I called ACAS who said that normally it would be 90 days from my last working day and it would be up to the tribunal to decide if this was the day I handed in my notice or my last official day working there.
They said that allowing the grievance procedure to be carried through is usually a reasonable cause for late submission but I would rather submit within the 90 days of my last official day if I can.
In terms of it happening over a long period of time, I went through this from August until December when I gave up and went off sick.
I have had a couple of private messages telling me to go for disability discrimination instead of constructive dismissal, does this seem sound?0 -
Disability discrimination is also very difficult to prove I believe, I think if you are going to go down that route, you should see an employment lawyer and ask their advice on which one you might have more success with.

Just thought I'd give an update.
I gave my old employer a week and then wrote to ask what was happening. In this letter i said that I had considered their offer of re-employing me and that given the events leading up to me leaving i could not return to work there. I said that I would settle for the salary I had missed out on from December to March and a goodwill gesture from the company to acknowledge their failings and to cover things like overdraft fees during the month where they decides to not pay me at all. In this letter I gave them a week to reply.
I did not receive a reply so I have submitted an ET1 form to the local tribunal. My answer to 5.2 is over 20 paragraphs long and that's the short version of events!
I'm hoping that ACAS will step in and do some mediation but I am prepared to fight all the way with this. I will be going it alone as I haven't been able to find any help for tribunal in Scotland.0
