Ex forged signature on secured loan

Hello

I wonder if anyone has any experience on the following?

My ex partner (I was with him at the time) forged my signature on a Black Horse secured loan. He subsequently went into arrears with the loan and this is the time when i both split with him and found out about the forgery. I reported him to the police who issued him with a formal caution.

I also got in touch with Black Horse and they wrote to me to tell me that they accepted my version of events and that I would be taken off the loan agreement. However, I have seen a copy of the land registry entry for my house and the Black Horse loan is still registered against the property as an equitable charge.

I have seen a solicitor who suggests that the loan will still stand but it was taken out without my consent and Black Horse have admitted that it was fraudulent, it seems unfair (understatement) Does anyone know how or even if there is anything that can be done?

    It's in both our names. On splitting up he (as recompense for his bad behaviour) signed over all the equity to me but now I am applying for a transfer of title so that it can be in my sole name.

    How much equity is there?

    How was it signed over?

    How much is the secured loan?

    What are the arrears?

    As Black Horse agree it is fraudulent, then you will need to ask them to remove the Charge on the property and see what they say.

    The equitable charge registered by Black Horse is against your ex partner's interest in the property. To the best of my belief, such an interest ain't worth much, but the only way of removing it alltogether would be to repay Black Horse.

    Was this loan taken out before the equity was signed over?

    Hi

    The loan was taken out before the transfer of equity. What I have trouble getting my head around is why the loan should be lodged against the house at all as I did not give my permission. I can understand Black Horse pursuing my ex for the money but think it should now be treated as an unsecured loan. I dread to think what the arrears are, i believe there will be rather sizeable admin / late payment charges.

    Possibly the security is only on your exs share of the equity.
