Rights as a human being to be spoken to in a proper manner by shift supervisor

I currently work for company that cleans for a major supermarket in a distribution centre,my problem is my shift supervisor who thinks its ok to shout and talk to her staff in a manner which many of us feel is rude and aggresive,when we said we was going to put a grievence in was told we would face a disciplinery,we dont have a site manager they left on ill health so who should we complain to any advice welcome,when i have raised concerns im told i have no rights till ive been in job a year if this is case why sign a contact,ive been with current employer since april and staff turnover is approx 2/3 leave and start every week.

    What you are being told is pretty much true. You can be dismissed for almost any reason - and you don't even have the right to know what that reason is - until you have worked there for a year. So if you complain, yes, there is a very real chance that you will be dismissed. If you still want to do something about this, then you do have to submit a grievance, but that is no guarantee that anything will be done. It is entirely difficult to prove bullying and you would have to show that you had used the grievance procedures to complain - and even then, there is no law against bullying at work. There are laws that have been used (with a lot of evidence) such as personal injury or unfair dismissal, but the latter isn't available to you until 12 months, and they are very hard to win on.
  • So if i put agrievance in i can be dismissed even though my contract has 4 stages for disciplinary procedures ie verbal,written,final written,statutory dismissal procedure,also job was on a 3 month probation period after this period u become a member of regular staff now ive not had this comfirmed probally due to fact we dont have a site manager so where do i stand on this.I have been there since april this year

    You don't have any rights unfortunately. How much do you need the job? I'd suggest some game playing if you're not desperate to hang onto the job. If she shouts or is aggressive then ignore her instructions. Only respond to instructions made in a polite and reasonable manner. Hopefully it won't take too long before she works it out.
  • Find out how to record conversations with your mobile phone.. gather a bit of evidence. However, you really don't have many rights in employment terms until you've been there a year.

    How many of those that have been there a while would support a group grievance?

    Any other sites/supervisors that you coud transfer to.

    Does the company have similar staff retention issues at other sites, can the turnover be linked to this persons attitude, would the company be interested in resolving this issue if they found out?

    If the company has a dismisal process that they/you signed up to then I think it should still use this as log as it is better than the legal minimum.
  • Thanks for your replys will have a word at work tonight with other staff members i know at least six of the 14 on shift will agree to do a group grievance.once again thanks for your suggestions
