TERMS AND CONDITIONS OF THE INTERNET GAME

Article 1
Organisers / Duration of the game
FOTOVISTA, a joint-stock company with a capital of 19,033,875 euros and headquarters at 183, rue du Chevaleret - 75016 Paris (France), listed on the Registre du Commerce et des Soci!t!s (Register of Companies and Commerce) in Paris under the number B352236244, is organising a game entitled “The Internet Game” between 13/04/2008 and 31/07/2008.


Article 2
Terms and conditions
The present terms and conditions are accessible on the French website https://www.pixmania.com or directly on https://www.pixmania.com/fr/fr/jeu-concours.html when you click on “Terms and Conditions”. The terms and conditions may also be sent free of charge to anyone who requests them in writing at the game’s address before 20/08/2008.

Article 3
Participants
This game is open to all adults, except for employees of the organising companies stated in article 1. Family members of employees of the organising companies mentioned above may not participate in the game.
It is specified that a person is identified by the surname, first name, address, date of birth and email address that have been provided by the person in question or recorded automatically. In the event of a dispute, only the listing on FOTOVISTA will be proof thereof.
The organising company reserves the right to proceed with checks in the context of the application of the present article.


Article 4
Principe
1) To enter this game, all participants must follow the steps below:
- Connect to the website dedicated to the game at https://www.pixmania.com or at the following address: https://www.pixmania.com/fr/fr/jeu-concours.html during the periods stated in article 1 (connection date and time in France being proof thereof).
- Read the entry terms and conditions,
Before the prize draw, each participant must register on the site by filling in the given form with their full and correct details. Any incorrect, partially completed or wrongful forms will lead to the immediate cancellation of the entry without possible appeal by the participant. Participants will also need to provide their e-mail address. Any incomplete or incorrect contact details will not be taken into account.
2) The game will take place as follows:
Once registered, players will be able to participate in the grand prize draw that will be held at the end of the game (see dates in article 1). When a player registers, they will receive a promotional code.
3) Extra points:
Once registered, participants may gain extra points if one or several of their friends register on the site thanks to invitations sent by them through the game interface. Additional points will only be rewarded when the friend registers. Each point gives the participant an extra chance of being drawn at random in the prize draw and winning one of the prizes in question. An e-mail confirming that the friend has registered will automatically be sent to the person who forwarded the invitation. Participants will be immediately eliminated from the game if they attempt to send invitations to fictitious addresses or friends, and their prizes will be awarded to another participant where appropriate.

DESCRIPTION OF PRIZES
Prizes do not include fees or additional services required for their use or enjoyment. These fees and services remain the winners' responsibility.
Prizes may not be disputed in any way, exchanged for their value in cash or any other form, or replaced or exchanged for any reason.
In force majeure cases or if circumstances require it, the organising companies reserve the right to replace the aforementioned prizes with similar prizes of an equivalent or superior value.


Article 6
Checking the winners’ contact details
Participants authorise the organising company to carry out checks on their identity and contact details if necessary. All false declarations will lead to the immediate elimination of the participant and their guests.

Article 7
Awarding prizes
All winners will be contacted by email in order to confirm their contact details. Please note that the contact details provided during registration must be the same as those used to send the prize.
If the postal address is not valid or if the participant does not reply to the email, the prize will be attributed to the person who entered the game just after the winning moment of the prize.
Prizes will be sent within six (6) weeks after the closing date of the game.
If a prize is returned with the label “Does not live at the given address” or if the prize sent by recorded delivery is not collected by the recipient, the winner will no longer be able to claim it.


Article 8
Personal information
Personal information provided by participants during the period of the game will be processed by a computer. This information is destined for internal use by FOTOVISTA and will not be transferred to third parties. Pursuant to the provisions of the law concerning IT and Freedoms dated 6 January 1978, participants may request not to be named in the file created by FOTOVISTA. Participants have the right to access, modify and delete their personal information at any time.


Article 9
Publication of winners’ names
The contact details of winners may be transferred by the organising companies to partners responsible for the delivery of certain prizes, who agree to only use them for this purpose.


Article 10
Responsibility
The organisers also reserve the right to cancel, modify, shorten or prolong the present game if events out of its control oblige it to do so, without it being held responsible in any way. Each amendment of the present terms and conditions will be deposited at the Notaries’ Office at SCP Montel-Simeone-Segura-Simeone, 21 rue Bonnefoy, 13001 Marseille, France. These amendments must be provided together with the terms and conditions to anyone who requests them.
The organising companies will not be held responsible for any possible problems provoked by the companies in charge of delivering prizes.
In addition, the organising companies will not be held responsible if, following incidents on the telephone line, the participant’s connection is interrupted or if their entry is not taken into account. The organising companies will not be held responsible if the participant’s connection to the Internet is interrupted for any reason, or if the participant is unable to access the site for any reason during the duration of the game.
The organising companies will not be held responsible if the game is cancelled because of force majeure circumstances.
In the same way, the organising companies reserve the right to definitively refuse entry to the game of anyone who, through fraudulent behaviour, would harm the smooth running of the game. Furthermore, the invitation of fictitious persons will lead to the immediate elimination of the participant and their guests. All attempts to enter the game without using the interface put into place on the site will be considered as an attempt at fraud. Moreover, the disassembly of the game, the use of personal scripts or any other action aiming to change the intended use of the game in the present terms and conditions will also be considered as an attempt at fraud and will lead to the immediate elimination of the participant, without possible appeal.
The organising companies reserve the right to eliminate a participant in the event of technical problems.
The organising companies also reserve the right to take action against all attempts to detract from the present terms and conditions, notably if the participant provides wrongful information.

Notaries’ Office
The present terms and conditions are deposited at the Notaries’ Office at SCP Montel-Simeone-Segura-Simeone, 21 rue Bonnefoy, 13001 Marseille, France.


Article 12
Refunds
Requests for participation fee refunds (on a basis of € 0.16 (£0.13) including VAT for a 4-minute connection) must only be addressed in writing to the game's official address: The FOTOVISTA Internet Game, 43-47 avenue de la Grande Arm!e, 75016, Paris, France.

Refund requests must be made before 20/08/2008 (postmark being proof thereof), and must specify the name of the game, the surname, first name and full address of the participant and, where appropriate, the telephone number used for the confirmation of their registration; the date and time of their entry(ies), their bank details, a copy of the contract and detailed invoice from their operator must also be sent, ensuring that the name mentioned on the latter is the same as the one given with the bank details. Incomplete or late requests will not be processed. Requests regarding the refund of Internet subscription fees (broadband, cable, etc), which do not prove that fees were incurred directly from participation in the game, will not be processed

Postage costs for participation refund requests are refunded on the basis of a second-class letter weighing less than 20 grams, with an explicit request included in the same letter.


Article 13
Claims
Claims concerning the game received more than one month after the closing date of the game will not be processed.
If the information provided by the participant cannot be used to advise the winner of their prize or to send it to them, the winner will lose their prize and may not make a claim at a later date. All disputes concerning the game and its terms and conditions will be settled, without possible appeal, by the organising company.
Participation in this game implies the acceptance, without reserve, of the full terms and conditions and the renunciation of the right to appeal.
All disputes arising from the application or interpretation of the present terms and conditions, which have not been provided for in the present document, will be settled by the courts in Paris according to French laws.
