My Rights & Those Of Debt Collectors

Hi all,

Just a quickie,

Do I have to give my name to debt collectors? The reason I ask is that AJR phoned me last month regarding the former occupier of my home (we moved in 14 months ago). I told them then that she no longer lived here, gave them the names of the solicitors who dealt with our house move, but refused to give them my name/surname. They phoned again today (well I had to phone them, they left an sms on my landline saying i needed to ring 0870). I got a bit angry and called them incompetent, threatened to report them to OFT/Telecommunications watchdog for harassment, they said they will do nothing as I have to give my name. Is there any reason i have to give it? I cant see how that will prove anything, and leave me liable for more hassle in the future?

TBH I mainly refused to give my name as I (like most people) dislike DC with a passion, and I want to make things as difficult for them as possible now. I know theres nothing they can do to me or my property, with or without my name.

so should I give them it or should I ignore them???

Cheers
k

  • You have done all you can to help the DCA, I would return any letters marked 'Gone Away' and ignore any calls. How did they get your mobile number?

Not too sure, but personally i wouldn't provide ANY details - not even my name. It may be their company policy to ask but you are under no obligation to tell them.

You are under no obligation to provide them with anything. They have to prove that YOU owe the debt.

    I know.

I find it easier to bookmark this page:

    http://www.oft.gov.uk/advice_and_resources/publications/guidance/consumer_credit_act/

That always seems to contain a valid link to the document, even when they switch urls.

    Hi all,

Sorry about the really late reply, I thought id thanked everyone earlier but obviously not!

I suspect they got my landline number as I think they are representing The Littlewoods Group, and I also have an account from them, guess they searched their database and found a matched address??? If this is the case, is it legal for Littlewoods to pass over my phone number to the DC under Data Protection????

    Thankss anyway

There is an excellent "What can they do to me" post written by a debt expert on The Motley Fool website here, which explains the rights of debt collectors etc.
