Kung Fu Panda Competition (Competition)
Terms and Conditions

Nickelodeon UK Limited of 15-18 Rathbone Place, London, W1T 1HU is the promoter of the Competition (Promoter).

These competition terms and conditions (Terms And Conditions) will apply to the Competition.

1. The closing date for this Competition shall be 23.59 on 16 March, 2008 (Closing Date).

2. Entrants must be aged between 7 and 15 years old (Entrants) at the date of the Closing Date.

3. Entrants may enter the Competition from 1st March 2008 until the Closing Date online at https://www.nick.co.uk/win by:

3.1 answering the question;

3.2 providing their contact details as requested; and

3.3 following the directions given by the Closing Date.

4. All Entrants must obtain parental consent prior to entering the Competition.

5. After the Closing Date, Promoter will randomly select 10 Entrants from all of the correct entries received (Finalists).

6. The Finalists will be notified by 10am on 19th March 2008 and will be required to undertake a telephone audition as directed by the Promoter by 6pm on 20th March 2008 (Audition). The Promoter will then select one winner only (Winner) from the Finalists whom the Promoter deems to have performed the best in the Audition.

7. The Winner will be notified telephone by 25th March 2008. Subject to confirmation and receipt by Promoter of the Winners’ address, parental/guardian consent, child licence, and/or contributor’s release form as required, the Winner will receive full written confirmation of the Prize within 5 days.

8. The Winner will need a valid child licence from their local education authority in place by 18th April 2008 before being able to receive their Prize. The Promoter will provide the Winner with details on applying for a child licence. Elements required for a child licence include a copy of the Winner’s birth certificate, doctor’s note certifying fitness and 2 passport photographs. It is the Winner’s parent’s/guardian’s responsibility to ensure that the paperwork and supporting documentation for applying for a child licence is with their local education authority on time to produce the licence.

9. The Competition is open to residents of UK and Eire excluding employees and relatives of employees of the Promoter and/or Paramount Pictures International (and/or their respective parent, subsidiary or affiliated companies), Promoter’s and/or Paramount Pictures International’s agents or any other person connected to this Competition.

10. One entry per household.

11. Prize(s) for this Competition are as follows:

11.1 The Winner (one winner only) will receive:

11.1.1 The chance for the Winner to take part in and have their voice recorded (Recording Session) for a character in the animated film “Kung Fu Panda” (Film).

The Winner and their parent/guardian (one parent/guardian only) must be available for the Recording Session between 28th April 2008 and 30th April 2008 on such date as notified to the Winner by the Promoter.

The Winner’s parent/guardian must remain with and be responsible for the Winner for the full duration of the Recording Session and any filming/recording (including all rehearsals and prep time);

Travel must take place on the dates and as specified by Promoter. Winners and their parents/guardians are advised to obtain their own travel insurance.

11.1.2 Standard return travel for the Winner and their parent/guardian from their nearest mainline train station to the mainline station nearest to the location for the Recording Session; and

11.1.3 a Nickelodeon prize pack which shall include a Spongebob Squarepants MP3 player; and

11.2 9 Finalists (excluding the Winner) will each receive a Nickelodeon prize pack which shall include a Spongebob Squarepants MP3 player.

12. The Winner must be available to attend the Recording Session on the date required by the Promoter. The Winner and/or their parent(s) or legal guardian(s) shall sign Paramount Pictures International Limited’s standard assignment of rights (available on request) before the Recording Session.

13. The Promoter reserves the right to select an alternative Winner and/or Finalist and award a Prize to another Entrant in the event that :

(a) the Promoter has reasonable grounds for believing that an Entrant has contravened any term or condition of entry;

(b) an Entrant has changed their address to one outside of the UK and/or Eire after the Closing Date;

(c) the Promoter is unable to contact an Entrant by 10am on 19th March 2008;

(d) the Entrants (and/or their parent/guardian) do not agree to or cannot comply with these Terms And Conditions;

(e) the Entrant’s parent/guardian does not wish for their child to receive the Prize;

(f) the Winner’s head teacher does not consent to the Winner’s absence from school if the date of the Recording Session is during term time; or

(g) the Promoter does not receive confirmation of the Finalists’ and/or Winner’s address, parental/guardian consent, child licence and/or contributor’s release form as may be requested within the time frames specified by the Promoter.

14. Costs to enter the Competition via the internet may vary so please check with your network operator for current charges. Entrants should seek the permission of the person paying the bill before entering.

15. The Promoter’s decision on all matters is final. No correspondence will be entered into.

16. The Promoter shall not be liable for any delay in performing or partial or total failure to perform any of its obligations to an Entrant under these Terms And Conditions if such delay or failure is caused by circumstances beyond the Promoter’s reasonable control including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation, war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes arising without limitation out of or in connection with:

(a) the activities of any third party including without limitation event organisers and/or venues;

(b) any form of transportation (including but not limited to flights, trains, coaches, buses, ferries, taxis or cars); and/or

(c) by third parties providing accommodation included in the Prize.

For the avoidance of doubt, the Entrants shall be solely liable for any additional costs incurred as a result.

17. The Promoter shall not be liable to the Entrants and/or their parent(s)/guardian(s) for any loss or damage howsoever caused (whether in contract, tort or statutory duty or otherwise) arising out of or in connection with this Competition and/or Prize other than death or personal injury caused by negligence of the Promoter and/or the Promoters personnel and/or deceit or fraud by Promoter and/or Promoter’s personnel.

18. Each Entrant and their parent/guardian irrevocably agree and consent to the Promoter, its successors, assignees and licensees, to:

18.1 the Entrant participating in the Competition, the Auditions, the Recording Session and/or any other elements as required and/or directed by the Promoter and consent to the recording of the Entrant as an individual and their voice as part of their performance that may be incorporated into the Film and/or any other elements, in whole or in part, in the Promoter’s sole discretion and each Entrant accepts that Promoter is under no obligation to use such performance and/or materials;

18.2 the exploitation of the Competition, the Auditions, Recording Session and/or any other elements, in whole or in part, (including the Winner’s performance) by any and all means and in all media and formats whether known or devised in the future throughout the world in perpetuity including without limitation cable and satellite television and websites;

18.3 the use and reproduction of the Finalist’s and/or Winner’s performance in the Auditions, Recording Session and/or any other elements and the recording of their performance, voice, image or any part by all means and in all media and formats whether known or in the future devised throughout the world in perpetuity for the purposes of advertising, broadcast, publicity or otherwise;

18.4 waive and release the Promoter from any claim, action or demand arising out of or in connection with the Competition, Auditions and/or Recording Session and/or any other elements; and

18.5 for the Winner’s parent(s)/guardian(s), sign the Promoter’s contributor’s release form before receiving the Prize.

19. To give all Entrants a chance of winning a prize, a maximum of one prize per household is permitted to be won from the Promoter within a 4-week period.

20. No responsibility can be accepted for entries lost, delayed, misdirected, damaged or undelivered. Incomplete, inaudible and/or illegible entries will be disqualified. The Promoter shall not be responsible for technical errors in telecommunications networks, internet access or otherwise preventing entry to any competition.

21. Prizes are as stated and are non-transferable. No cash alternatives will be offered. If due to circumstances beyond the Promoter's control, the Promoter is unable to provide the stated Prize (or any part) the Promoter reserves the right to award a substitute prize (or part). Prizes are subject to the additional terms and conditions of the manufacturer or supplier.

22. Travel in respect of this Competition will take place in accordance with the dates and any restrictions specified by Promoter. If the date is in school term-time, the Winner must obtain the prior written consent from their head teacher for any absence from school.

23. By entering the Competition, Entrants acknowledge that they may be required to be used in publicity without further consent or payment. Such publicity may include without limitation the Entrant’s, Finalists’ and/or Winner’s name and/or likeness, voice, photographs and/or video footage, biographical information and/or any statement made by them concerning the Competition, Prize and/or any element. Entrants agree that such publicity may be used by the Promoter in any and all media in perpetuity throughout the world as the Promoter in its sole discretion sees fit.

24. Any personal information collected by the Promoter in connection with the Competition will be used in accordance with the Promoter’s Privacy Policy which can be viewed at https://www.nick.co.uk/#/privacy or can be obtained by writing to the Promoter either by email at letterbox@nick.co.uk or by post to the Promoter’s address marked for the attention of The Data Protection Officer. If Entrants don’t want the Promoter to use their information in this way, Entrants can tell the Promoter when entering the competition or at any time by writing to the Promoter as set out above.

25. A list of the Finalists and the Winner for the Competition can be obtained by sending a stamped addressed envelope to the Promoter marked “Kung Fu Competition Winners List” by 21 April 2008.

26. Entrants agree to be bound by these Terms And Conditions. Entrants may be required to provide a written acknowledgement of all terms and conditions of the Competition.

27. These Terms And Conditions shall be governed by and construed in accordance with the laws of England and the courts of England shall have exclusive jurisdiction in relation to any disputes arising therefrom.
